Method for Determining Legal Aid Time by Actual Sessions When Changing Legal Aid Providers

Method of determining the duration of legal aid sessions in reality when changing the legal aid executor is stipulated in Clause 3, Article 8 of Circular 02/2021/TT-BTP (Effective from July 15, 2021) as follows:

- The time used as the basis for paying remuneration and bonuses for the individual being replaced or altered is the actual time they have provided legal aid up to the point of replacement or alteration;

- The time used as the basis for paying remuneration and bonuses for the appointed replacement is the actual time they continue to perform tasks from the point of being appointed as a replacement.

If the appointed replacement opts for the case-by-case payment method, the total remuneration and bonuses for both individuals (the replacement and the replaced or altered) shall not exceed the case-by-case payment limit as stipulated in Appendix No. 01, Appendix No. 02, and Appendix No. 03 issued alongside this Circular.
