Which Acts Are Required to Submit the Illegally Gained Profits in the Implementation of Private Telecommunication Network Establishment Licenses?

Based on Article 17 of Decree 15/2020/ND-CP (effective April 15, 2020), regulating violations of the provisions regarding the implementation of private telecommunications network licenses as follows:

- A fine ranging from VND 10,000,000 to VND 20,000,000 for actions of providing services to organizations or individuals who are not members of the private telecommunications network.

- A fine ranging from VND 70,000,000 to VND 100,000,000 for actions of using the private telecommunications network for the purpose of business telecommunications services.

- Additional sanctions:

Revocation of the private telecommunications network establishment license from 01 month to 03 months for violations stipulated in Clause 1 and Clause 2 of this Article.

- Remedial measures:

Mandatory forfeiture of illegal profits obtained from committing the violation stipulated in Clause 2 of this Article.

=> Thus, any act of using the private telecommunications network for the purpose of business telecommunications services will be subject to mandatory forfeiture of illegal profits obtained from committing such acts.
