Article 35 of the 2011 Charter of the Communist Party of Vietnam stipulates as follows:
1. Party organizations and party members who violate discipline must be handled fairly, accurately, and promptly.
2. Form of discipline:
- For party organizations: reprimand, warning, dissolution;
- For official party members: reprimand, warning, dismissal, expulsion;
- For reserve party members: reprimand and warning.
Thus, if you are a reserve party member, you will not be subject to the disciplinary form of expulsion, but will only be subject to a reprimand or warning according to the provisions of law in Vietnam.
In Clause 4.6, Article 4, Instruction 01-HD/TW 2021 stipulates procedure for removing the name of reserve party members who violate their status as follows:
a) The Party cell considers, if two-thirds or more of the official party members vote to agree to delete the names of reserve party members, then issue a resolution and report to the superior party committee.
b) The grassroots Party Committee will consider and, if two-thirds or more of the party members vote to agree to delete the names of reserve party members, issue a resolution and report to the competent party committee.
c) The Standing Committee of the Party Committee has the authority to admit party members for consideration. If more than half of the members vote in favor of deleting their names, they will issue a decision to delete their names.
d) The grassroots Party Committee authorized to decide on admission of party members shall decide to delete the names of reserve party members if approved by at least two-thirds of the current party members.
According to this Article, in case you violate discipline, your name can still be removed from the party list according to the provisions of the law mentioned above in Vietnam.

In Article 4, Instruction 01-HD/TW 2021, regulations on dossiers and procedures for recognition of reserve party members as official party members are as follows:
4.1. Certificate of training for new party members
Reserve party members must attend a training course for new party members and be issued a certificate by the district-level political center or party committee with authority to admit party members according to the form of the Central Organizing Committee.
4.2. Self-criticism of reserve party members
After 12 months from the date of admission to the Party cell, reserve party members write a self-criticism document clearly stating the advantages and disadvantages in performing party member duties and measures to overcome shortcomings and shortcomings; Request the party cell to consider and recognize official party members.
4.3. Comments on reserve party members from official party members assigned to help
Party members are assigned to help write a review of reserve party members, clearly stating the party member's strengths, weaknesses, ideological stance, awareness of the Party, ethics, lifestyle, and level of completion of assigned tasks; cell report.
4.4. Comments from the socio-political organization at the workplace and the party committee at the place of residence
The Party Committee has a reserve party member who synthesizes comments from the socio-political organization of which he or she is a member; Comments from the Party Committee or Party Committee (where there is no Party Committee) at the place of residence for reserve Party members to report to the Party Committee.
In special cases, it is not necessary to get comments from the party committee or cell where the party members reside, for reserve party members to comply with the regulations of the Secretariat.
4.5. Resolutions of party cells and grassroots party committees and decisions to recognize official party members of competent party committees
a) Contents and procedures of party cells, section party committees (if any), grassroots party committees, and authorities competent to consider and decide to officially recognize party members shall comply with Points 3.6 and 3.7, Section 3 of this Guide.
b) After the decision of the competent authority to officially recognize party members, the Party Committee shall announce the decision during the most recent Party cell meeting.
