According to Article 43 of Decree 115/2020/ND-CP, the term of holding a management position is stipulated as follows:
1. The term for holding a management position for each appointment is 05 years, starting from the effective date of the appointment decision, except for cases where the term is less than 05 years according to specialized legal regulations.
- The term for a public employee to hold a management position shall not exceed two consecutive terms as per specialized legal regulations.
Therefore, according to the above regulation, a term for a public employee in a management position is 05 years. In your case, Principal R who has just been appointed will have a 5-year term, not 3 years.
What are the standards and conditions for the appointment of a public employee in a management position?
Article 44 of Decree 115/2020/ND-CP stipulates the standards and conditions for the appointment of a public employee in a management position as follows:
Ensure general standards according to the regulations of the Communist Party, the State, and specific standards of the appointment position as prescribed by the competent authority.
Must be planned for the appointment position if sourced internally or planned for an equivalent position if sourced externally. In the case of a newly established unit that has not yet approved the plan, the competent authority shall consider and decide.
Have personal records verified, with a declaration of assets and income as required.
Conditions regarding appointment age:
a) The public employee proposed for the first-time appointment to a management position or proposed for appointment to a higher management position must have at least 05 years of working time remaining from the commencement of the appointment process; in special cases, the competent authority shall consider and decide;
b) The public employee proposed for appointment to a management position with a term of less than 05 years according to specialized regulations must have a working time sufficient for one term;
c) The public employee appointed to a new position equivalent to or lower than the current position does not need to meet the age requirements stipulated at point a of this clause.
Have sufficient health to complete the assigned tasks and duties.
Must not fall under cases prohibited from holding positions according to the regulations of the Communist Party and the law; not currently under disciplinary action, not in the period of implementing regulations related to the discipline of public employees as stipulated in Article 56 of the Law on Public Employees amended and supplemented at clause 8 Article 2 of the Law amending and supplementing several articles of the Law on Cadres, officials and the Law on Public Employees.
