What are rights and interests of civil servants and public employees in Vietnam who are sent for training and retraining?
Pursuant to Article 25 of the Regulation on training and retraining of civil servants and public employees of the People's Procuracy promulgated together with Decision 303/QD-VKSTC in 2020 stipulating rights and interests of civil servants and public employees in Vietnam who are sent for training and retraining as follows:
1. For civil servants and public employees sent for domestic training and retraining:
a) Time and budget are allocated by the management and use agency as prescribed;
b) The training and retraining time is counted into the continuous working time;
c) To enjoy the regimes and allowances as prescribed by law;
d) To be commended and rewarded for excellent learning results in training and retraining.
2. Civil servants and public employees who are sent abroad for training and retraining shall enjoy benefits as prescribed by law, the People's Procuracy branch and their units.
3. Female civil servants and public employees who are sent to study are from ethnic minorities. In addition to the benefits specified in Clauses 1 and 2 of this Article, they are entitled to the rights prescribed by the law on gender equality and ethnic work.
What are responsibilities of public civil servants and public employees specialized in procuracy in Vietnam sent for training and retraining?
Pursuant to Article 26 of the Regulation on training and retraining of civil servants and public employees of the People's Procuracy promulgated together with Decision 303/QD-VKSTC in 2020 stipulating responsibilities of public civil servants and public employees specialized in procuracy in Vietnam sent for training and retraining as follows:
1. Comply with regulations on training and retraining of civil servants and public employees and have the following obligations:
a) Comply with the policies and laws of Vietnam and the sending country for training and retraining, and regulations of domestic and foreign training and retraining institutions;
b) Study, research and practice in accordance with the regulations on term, level of study, major and training level stated in the decision on sending to school;
c) Annually, report the progress and learning results in writing to the employing unit and the civil servant management unit (for training courses lasting more than 12 months);
d) Report in writing study results, the observance of policies, laws, and disciplinary regimes during the study period accompanied by diplomas and certificates (certified copies) of the unit managing the civil servants and public employees within 15 working days from the date of completion of the course for the case of studying in the country and within 15 working days from the date the civil servant or public employee returns home, for the case of studying abroad. In case for objective reasons, civil servants and public employees have not been granted diplomas or certificates right after graduating from the course.
There should be a written certification of the training results from the training institution and the civil servant or public employee is responsible for submitting a certified true copy of the diploma or certificate within 05 working days from the date the civil servant or public employee receives the diploma or certificate. In case of studying abroad and there is an agency managing overseas students and Vietnamese officials to study, the civil servant or public employee must have a written comment from that agency;dd) Complete the learning tasks on time and with the defined goals; If, for objective reasons, do not complete the course or have to prolong the study period, it must report to the Head of the unit managing and employing civil servants, public employees and training and retraining establishments for consideration and decision;
e) After completing the training and retraining program, continue to perform professional tasks at the agency or unit that has sent for training and retraining for at least 02 times the time of training and retraining, unless there is a different decision (mobilization, change of working position...) by the competent agency or person.
2. Comply with regulations on compensation for training expenses.
3. Implement training and retraining regulations and be under the management of the training and retraining institution during the course participation.
What are regulations on handling violations in training and retraining civil servants and public employees of the Procuracy in Vietnam?
Pursuant to Article 27 of the Regulation on training and retraining of civil servants and public employees of the People's Procuracy promulgated together with Decision 303/QD-VKSTC in 2020 stipulating regulations on handling violations in training and retraining civil servants and public employees of the Procuracy in Vietnam as follows:
1. Civil servants and public employees who fail to comply with the agency or unit's decision to send them to training and retraining without plausible reasons shall be considered for disciplinary action according to the provisions of the law on discipline of civil servants and public employees.
2. Civil servants and public employees who are sent to training and retraining, if they violate the obligations specified in this Regulation and other provisions of law, depending on the seriousness of their violations, they will be handled according to the provisions of current law.
3. If civil servants and public employees are sent to training and retraining, if they violate the regulations and rules of the training and retraining institution, they will be notified to the agency or unit for handling in accordance with the law and the People's Procuracy.
4. Civil servants and public employees may be sent abroad for long-term training and retraining if they do not return home on time without written approval from the Supreme People's Procuracy or return home but do not continue to work in the People's Procuracy or have not worked for the minimum amount of time as committed, but voluntarily quit their jobs, they will be disciplined for dismissal and compensate for training and retraining expenses according to regulations.
