What are procedures for sending civil servants and public employees of the Ministry of Justice to training and retraining in Vietnam? 

Pursuant to Article 8 of the Regulation on training and retraining of civil servants and public employees of the Ministry of Justice promulgated together with Decision 1318/QD-BTP in 2022 stipulating procedures for sending civil servants and public employees of the Ministry of Justice to training and retraining are:

1. For cases of sending for training and retraining within the competence of the leaders of the Ministry and the Director of the Department of Organization and Personnel:

a) In case of sending for training and retraining in the country:

Based on the direction of the leaders of the Ministry and the notices of the training institutions about the training and retraining courses, the Department of Organization and Personnel shall publicly announce in writing the subjects, conditions, standards, Target to participate in training and retraining courses to units under the Ministry. Units shall review and propose lists and dossiers as prescribed in Article 9 and send them to the Department of Organization and Personnel. The Department of Organization and Personnel decides or advises and submits to the Ministry's leadership for consideration and decision to appoint civil servants and public employees for recruitment/studying according to regulations.

In case civil servants and public employees contact training courses by themselves, they must send dossiers as prescribed at Points a, c and d, Clause 1, Article 9 of this Regulation to the unit directly managing civil servants, public employees. The units directly managing civil servants and public employees shall review and propose the list and application documents for admission/schooling and send it to the Department of Personnel and Organization. The Department of Organization and Personnel decides or advises and submits to the Ministry's leadership for consideration and decision to appoint civil servants and public employees for recruitment/studying according to regulations.

b) In case of sending abroad for training and retraining:

Based on the direction of the leadership of the Ministry and the announcement of the relevant agencies about the training and retraining course, the Department of Organization and Personnel shall publicly announce in writing the subjects, conditions, standards, the target of participating in the course to the relevant units. Units shall review and propose lists and application documents for admission/school attendance according to the provisions of Article 9 of this Regulation and send it to the Department of Organization and Personnel. The Department of Personnel and Organization advises and consults with the Department of International Cooperation, the leaders of the Ministry are assigned to be in charge of the field of international cooperation and the leaders of the Ministry are assigned to be in charge of the field of training and fostering civil servants, public employees before submitting to the Minister for consideration and decision to appoint civil servants and public employees to enroll/study in accordance with regulations.

In case civil servants and public employees contact training and retraining courses by themselves (except for the case where civil servants and public employees self-contact training and retraining courses of less than 3 months without using funds from other sources). funding for training and retraining of civil servants and public employees of the Ministry of Justice) must send dossiers as prescribed at Points a, c and d, Clause 1, Article 9 of this Regulation to the unit directly managing civil servants. , public employees. In case civil servants and public employees contact training and retraining courses on their own with a duration of less than 3 months without using funds from the Ministry of Justice's training and retraining funds, the Minister of Justice shall the unit directly managing civil servants and public employees shall consider and allow civil servants and public employees to apply for recruitment and send the results of the recruitment and the dossiers as prescribed in Article 9 of this Regulation on the Personnel and Organization Department. The Department of Personnel and Organization advises and consults with the Department of International Cooperation, the Deputy Minister is assigned to be in charge of the field of international cooperation and the Deputy Minister is assigned to be in charge of the field of training and fostering civil servants and employees. before submitting to the Minister for consideration and decision to send civil servants and public employees to study in accordance with regulations.

c) In special cases, due to the requirements of the course or the requirements of the training and retraining plans for civil servants and public employees of the Ministry of Justice, it is necessary to personally appoint the civil servants and public employees for training and retraining. The Department of Organization and Personnel discussed with the Head of the relevant unit, then the Department of Personnel and Organization decided or advised and submitted to the Ministry's leadership for consideration and decision according to regulations.

2. For cases of sending for training and retraining in the country under the competence of heads of non-business units under the Ministry, Director of Southern Department of Work and heads of units with non-business units: According to the written notification of the Department of Organization and Personnel about the contents, targets, subjects, conditions and criteria for participating in training courses, the head of the unit shall publicly announce the contents and targets. of the course and the training and retraining needs of the unit; consider and decide to nominate public employees for recruitment/studying in accordance with regulations, and at the same time send documents on nomination of public employees for recruitment/studying to the Ministry of Justice (Department of Organization and Personnel) for monitoring and management.

In case civil servants and public employees contact training and retraining courses by themselves, they must send dossiers as prescribed at Points a, c, and d, Clause 1, Article 9 of the Regulation on units directly managing public employees. Units directly managing public employees consider and decide to nominate public employees for recruitment/studying in accordance with regulations, and send documents on nomination of public employees for recruitment/studying to the Ministry of Justice (Department of Personnel and Organization) for approval for monitoring and management.

3. In case of sending abroad for training and retraining under the authority of the Rector of Hanoi Law University and the Director of the Judicial Academy: Based on the written notice of the Department of Organization and Personnel about contents, targets, subjects, conditions and standards for participating in training and retraining courses, the Rector of Hanoi Law University and the Director of the Academy of Justice publicly announce the contents and targets of the course on training and retraining needs of the unit; consult with the Department of International Cooperation and the Department of Organization and Personnel before deciding to nominate public employees for recruitment/studying according to regulations, and send a written nomination of public employees to the Ministry of Justice (Department of Organization officers) to monitor and manage; In case the content is related to national sovereignty, security, defense, ethnicity, religion,

In case the public employee personally contacts the training and retraining courses, he/she must send the dossier as prescribed at Points a, c, and d, Clause 1, Article 9 of this Regulation to the unit directly managing the public employee. Units directly managing public employees consult the International Cooperation Department and the Personnel Organization Department before considering and deciding to nominate public employees for recruitment/studying in accordance with regulations, and send a document to nominate public public employees at the same time to apply/attend school to the Ministry of Justice (Department of Organization and Personnel) for monitoring and management.

What does dossier to register for recruitment to train and foster civil servants and public employees of the Ministry of Justice in Vietnam comprise?

According to Clause 1, Article 9 of the Regulation on training and retraining of civil servants and public employees of the Ministry of Justice promulgated together with Decision 1318/QD-BTP in 2022, stipulating the application for recruitment training and retraining of civil servants, public employees of the Ministry of Justice as follows:

1. An application file for recruitment includes:

a) An application form, clearly stating: full name, year of birth, position, rank of civil servant, public employee, working period, current duties, major graduated, major in which the project is registered. examination, title of research topic, time of research (if any). In case of self-contacting for training and retraining courses in the application, please specify the majors to be recruited, it is expected that the training institutions will register for the recruitment, the destination country and the duration of the project on recruitment (maybe more than 01 year).

c) The enrollment notice of the training institution in case of self-contact for training and retraining courses (if any);

d) Other documents required by the course.

What is application for admission to training and retraining of civil servants and public employees of the Ministry of Justice in Vietnam? 

In Clause 2, Article 9 of the Regulation on training and retraining of civil servants and public employees of the Ministry of Justice promulgated together with Decision 1318/QD-BTP in 2022 stipulates application for admission to training and retraining of civil servants and public employees of the Ministry of Justice is as follows:

2. The application for admission includes:

a) The document appointing civil servants and public employees to attend school of the head of direct management;

b) Admission notice of the training institution;

c) A written commitment to perform tasks at the agency or unit after completing the training program, in case of going to graduate training (form No.01/DTBD);

d) Other documents required by the course.
