What are duties and powers of the Ministry of Information and Communications regarding radio frequencies in Vietnam?

Pursuant to the provisions of Clause 13, Article 2 of Decree 48/2022/ND-CP, duties and powers of the Ministry of Information and Communications regarding radio frequencies are as follows:

13. About radio frequencies

a) Guide and organize the implementation of the national radio frequency spectrum planning; transmission and broadcasting activities according to the master plan on information and communication infrastructure approved by the Prime Minister;

b) To assume the prime responsibility for, and coordinate with the Ministry of National Defense and the Ministry of Public Security in, allocating frequency bands for defense and security purposes to submit to the Prime Minister for approval;

c) To promulgate the frequency band planning, frequency channelization planning, frequency channel use planning, regulations on conditions for allocation, assignment and use of radio frequencies and radio frequency bands;

d) Manage radio emission quality, electromagnetic compatibility and radio radiation safety in accordance with law;

dd) Regulations on technical conditions, conditions for exploitation of license-exempt radio equipment, technical conditions (frequency, transmission power) for radio equipment before production export or import for use in Vietnam;

e) Regulations on training of radio operators; radio operator certificate; subjects, conditions and procedures for granting, renewing and re-granting radio operator certificates; recognize the certificate of marine radio operator for foreign crew members working on board ships flying the Vietnamese flag;

g) Granting, extending, amending, supplementing, temporarily suspending, suspending and withdrawing radio frequency licenses;

h) Inspect and control radio frequencies and equipment, handle harmful interference;

i) International frequency registration, international coordination on radio frequencies and satellite orbits;

k) Submit to competent authorities for promulgation and organize the implementation of regulations on auction and transfer of the right to use radio frequencies.

Pursuant to Clause 14, Article 2 of Decree 48/2022/ND-CP, duties and powers of the Ministry of Information and Communications on information technology industry are as follows:

14. About the information technology industry

a) Guide, direct and organize the implementation of strategies, plans, policies, programs, schemes and projects on development of information technology industry and digital technology industry;

b) Submit to competent authorities for promulgation or promulgate according to their competence policies, incentives and priorities for investment in development of information technology industry, digital technology industry; publicizing the list and formulating the development program of key information technology products;

c) Appraisal of programs, plans and projects on development of information technology industry, digital technology industry, contents of trade promotion and investment promotion in the field of information technology industry, projects to develop information technology products using scientific and technological capital from ministries, branches and localities;

d) Issue or submit to competent authorities for promulgation criteria for evaluation and certification of functions and technical features of information technology industry products, digital technology industry; mechanisms and policies on management and development of centralized information technology zones;

dd) Issuing, extending, temporarily suspending, suspending and withdrawing licenses, certificates and certificates in the information technology industry, digital technology industry, information technology human resources; promulgate and recognize information technology skill standards;

e) Organize activities to support investment promotion and trade promotion in the information technology industry, digital technology industry;

g) Implement quality management for products and services in the field of information technology industry, digital technology industry according to the provisions of law.

Pursuant to the provisions of Clause 15, Article 2 of Decree 48/2022/ND-CP, duties and powers of the Ministry of Information and Communications on national digital transformation are as follows:

15. About country number conversion

a) Perform the standing duties of the National Committee on Digital Transformation; acting as the focal point for synthesizing, advising and coordinating interdisciplinary coordination activities among ministries, branches and localities to implement guidelines, strategies, mechanisms and policies to create a legal environment, promote public application. information technology, national digital transformation, development of e-government, digital government, digital economy, digital society and smart city;

b) Guide and organize the implementation of mechanisms, policies, strategies, plans, programs and national projects on information technology application in state agencies, building e-Government and Government number; to guide, appraise, examine and evaluate the formulation and implementation of programs, plans, schemes and projects on information technology application, e-Government development, and digital government, branches and localities according to their competence; evaluate and verify the quality of information technology application products and solutions.

Develop, maintain, update, organize the implementation of the Vietnam E-Government Architecture Framework, ICT Reference Framework for smart city development; guide, supervise and support data governance, data sharing and exploitation activities in state agencies; building and operating an information system testing room; building, managing and operating an integrated platform, sharing national data, a national data portal, a platform to monitor and measure the level of provision and use of digital government services, a computing platform Government cloud and digital platforms for building e-Government, digital government according to authority;

c) Guide, organize the implementation of mechanisms, policies, laws, strategies, plans, programs and national projects on the digital economy, promote the application of information technology, digital transformation of enterprises according to regulations of the Law;

d) Guide and organize the implementation of mechanisms, policies, strategies, laws, national plans, programs and projects on the digital society, promote information technology application, and operate in compliance with laws and regulations on code of conduct on digital environment in society and community.
