Revocation of Officer Rank When a Commander Uses Corporal Punishment on Subordinates
Based on Clause 2b Article 17 of Circular 16/2020/TT-BQP, the regulations are as follows:
A commander or superior who uses verbal insults or actions that offend the dignity, honor, or body of a subordinate shall be disciplined ranging from a reprimand, warning to salary demotion, and rank demotion.
If any of the following violations are committed, the discipline shall range from demotion, dismissal, revocation of officer rank to deprivation of military title, or mandatory discharge:
a) Previously disciplined but still violates;
b) Causes injury or health damage but not to the extent of criminal prosecution.
Thus, in cases where an officer in command uses corporal punishment on a subordinate causing injury that does not reach the level of criminal prosecution, the revocation of officer rank can still be applied.
