Regulations on principles of inspection by the People's Police?
Pursuant to Article 4 of Circular 128/2021/TT-BCA stipulating the principles of inspection as follows:
Comply with the provisions of Article 7 of the Law on Inspection, Article 6 of Decree No. 41/2014/ND-CP dated May 13, 2014, of the Government of Vietnam regulating the organization and operation of the People's Police inspection; the regulations of this Circular and other relevant legal provisions.
Inspection activities are carried out according to the policies of the head. Members of the Inspection Team must comply with the decisions and instructions of the Chief Inspector; the head of the agency or unit presiding over the inspection, the Chief Inspector must comply with the decisions and instructions of the person making the inspection decision.
Members of the Inspection Team, the Chief Inspector, and the heads of the agencies or units presiding over the inspection have the right to reserve their opinions on issues related to the results of the assigned tasks.
Forms of inspection by the People's Police?
Pursuant to Article 5 of the above Circular, forms of inspection are stipulated as follows:
Specialized inspections are conducted in the following forms:
a) Inspections according to the approved plan;
b) Unexpected inspections.
Unexpected inspections are conducted in the following cases:
a) When detecting that agencies, organizations, or individuals show signs of violating laws on national security, order, and social safety;
b) Upon request for resolving complaints, denunciations, anti-corruption activities;
c) As assigned by the heads of state management agencies with jurisdiction.
