Is It Legal for an Uncle to Participate in the Official Recruitment Panel When His Nephew is an Applicant?
Clause 3, Article 7 of Decree 138/2020/ND-CP stipulates:
Individuals who have a relationship as father, mother, brother, sister, or biological sibling of the candidate, or of the spouse of the candidate; the spouse, biological or adopted child of the candidate; or those currently under disciplinary action or executing a disciplinary decision shall not be appointed as members of the Recruitment Council or as members of the departments assisting the Recruitment Council.
According to the above regulation, the case of an uncle participating in the official Recruitment Council where his nephew is a candidate does not fall under the prohibition of non-appointment to the Council, so this appointment is still conformable.
