If civil servants go to intensive training for more than 6 months a year, are quality assessments and ratings conducted in Vietnam? Who pays for centralized training for civil servants in Vietnam? What is civil servant training and retraining regime in Vietnam?
Hello, I have a problem that needs to be answered. I am currently a civil servant and in the near future my agency will conduct quality assessment and grading. I have been in intensive training for more than 6 months, will I be evaluated and graded?

Clause 2, Article 2 of Decree 90/2020/ND-CP stipulates principles for evaluating and classifying the quality of cadres, civil servants and public employees as follows:
3. Officials, civil servants, and public employees whose working time in the year is less than 06 months are not subject to quality assessment and grading but must still review their working time during the year, except for cases of leave.
Officials, civil servants, and public employees who take a leave of absence from work according to the provisions of law during the year from 03 months to less than 06 months will still be evaluated but will not grade the quality at a level of good task completion or higher.
For officials, civil servants, and public employees taking maternity leave according to the provisions of law, the quality rating results for the year are the quality rating results of the actual working time of that year.
According to Article 49 of the 2008 Law on Cadres and Civil Servants, the responsibilities and benefits of civil servants in training and retraining are stipulated as follows:
1. Civil servants attending training and retraining shall strictly observe training and retraining regulations and submit to the management of training and retraining institutions.
2. Civil servants attending training and retraining are entitled to full salaries and allowances, with the training and retraining durations included in the continuous seniority period and considered for salary raise in accordance with law.
3. Civil servants with excellent performance in training or retraining courses are entitled to praise and reward.
4. Trained or retrained civil servants who give up or discontinue their jobs without permission shall refund training and retraining expenses in accordance with law.
Thus, the time civil servants spend participating in training and fostering is still counted as continuous seniority. If you are a civil servant and have gone to intensive training for more than 6 months, that time is still counted as working time. According to this Article, you will still be evaluated and graded for quality.

Who pays for centralized training for civil servants in Vietnam?
Pursuant to Article 48 of the 2008 Law on Cadres and Civil Servants, it stipulates responsibilities of agencies, organizations and units for civil servant training and retraining as follows:
1 Agencies, organizations and units managing civil servants shall formulate and publicize training and retraining plannings and plans to create sources and raise specialized or professional capabilities and qualifications for civil servants.
2. Agencies, organizations and units employing civil servants shall create conditions for civil servants to attend training and retraining to raise their specialized or professional capabilities and qualifications.
3. Civil servant training and retraining funds are covered by the state budget and other sources in accordance with law.
Therefore, funding for civil servants to attend centralized training is provided by the state budget and other revenue sources according to the provisions of law in Vietnam.
What is civil servant training and retraining regime in Vietnam?
Article 47 of the 2008 Law on Cadres and Civil Servants stipulates civil servant training and retraining regime as follows:
1. The contents, program, forms and durations of civil servant training and retraining must be based on criteria for leading and managerial titles and posts, criteria for civil servant ranks and suitable to task requirements.
2. Civil servant training and retraining include:
a/ Retraining based on civil servant rank criteria;
b/ Training and retraining according to leading and managerial titles.
3. The contents, programs and durations of civil servant training and retraining shall be stipulated by the Government.
Above are the provisions of law on training and fostering regimes for civil servants in Vietnam.
