During the period of delegation of authority, is one entitled to receive a position allowance?
Clause 1 Section II of Circular 02/2005/TT-BNV stipulates as follows:
"1. Principle
Officials and public employees who are elected or appointed to hold any leadership titles shall enjoy the position-based allowance according to that leadership title; if a person simultaneously holds multiple leadership titles, they shall enjoy the highest position-based allowance."
According to this regulation, officials and public employees who are elected or appointed to hold any leadership titles shall enjoy the position-based allowance according to that leadership title.
If the Vice Chairman of the Commune People's Committee is assigned the role of Chairman of the Commune People's Committee, during this period, the title you hold remains Vice Chairman of the Commune People's Committee.
Therefore, during the assignment period, you are not entitled to the position-based allowance of the Chairman of the Commune People's Committee but only the allowance for the position of Vice Chairman of the Commune People's Committee.
