Chairman of the Commune Fatherland Front Committee Concurrently Serving as Commune Military Commander: Entitled to Additional Allowances?
According to Article 61 of the 2008 Law on Cadres and Civil Servants, it is stipulated that the President of the Vietnam Fatherland Front Committee is a commune-level cadre and the Chief Commander is a civil servant.
According to the provisions of Article 10 of Decree 92/2009/ND-CP, as amended by Clause 3, Article 2 of Decree 34/2019/ND-CP, it is stipulated: Commune-level cadres and civil servants who concurrently hold a position that reduces the number of staff by 01 person from the maximum number prescribed in Clause 1, Article 4 of this Decree, from the date of the decision by the competent authority on concurrent holding, shall be entitled to a concurrent holding allowance including: 50% of the salary (step 1), plus the position allowance (if any) of the concurrently held position. In cases of concurrently holding multiple positions (including cases where the Secretary of the Party Committee is also the Chairman of the People's Committee, or the Secretary of the Party Committee is also the Chairman of the People's Council), only one concurrent holding allowance shall be provided.
The concurrent holding allowance for commune-level cadres eligible for concurrent holding allowance stipulated in Clause 1, Article 10 of Decree No. 92/2009/ND-CP, as amended and supplemented in Clause 3, Article 2 of Decree No. 34/2019/ND-CP, is stipulated as follows: Commune-level cadres who concurrently hold the position of commune-level civil servants are entitled to a concurrent holding allowance equal to 50% of the salary at step 1 of the administrative civil servant grade currently applied to the commune-level cadre assigned to the concurrent position.
Therefore, in your case, you will be entitled to a concurrent holding allowance of 50% of the salary at step 1 of the commune-level military commander grade.
