Can businesses providing real estate counseling services advise real estate price in Vietnam?

In Clause 2, Article 74 of the Law on Real Estate Business 2014, there are provisions on real estate counseling services as follows:

2. Real estate counseling services contain:

a) Legal counseling on real estate;

b) Counseling on real estate creation and trading;

c) Counseling on real estate finance;

d) Counseling on real estate price;

dd) Counseling on real estate sale, transfer, lease, sublease or lease purchase agreement.

Thus, according to current regulations in Vietnam, businesses providing real estate counseling services are allowed to advise on real estate price.

Can businesses providing real estate counseling services decide on real estate price during the consultation process in Vietnam?

Clause 3, Clause 4, Article 74 of the Law on Real Estate Business 2014 provides as follows:

3. Counseling content and scope, rights and obligations of contracting parties, real estate counseling fees shall be agreed by contracting parties.

4. The real estate counseling service providers shall take responsibility for commitment in the agreement and compensation for damage caused by the enterprise.

According to this Article, businesses providing real estate counseling services are not allowed to decide the price during the consulting process in Vietnam, the price during the counseling process will be agreed upon by the two parties in the contract.
