Last week I just lost my wallet so my identification documents are still being redone. However, I want to withdraw lump-sum social insurance. Can I use an identity certificate to replace my ID card or driver's license when withdrawing lump-sum social insurance?

Pursuant to Article 109 of the 2014 Law on Social Insurance, regulations on dossier for enjoyment of lump-sum social insurance allowance are as follows:

1. The social insurance book.

2. The employee’s application for enjoyment of lump-sum social insurance allowance.

3. For persons who settle abroad, a copy of the competent agency’s written certification of renunciation of Vietnamese nationality, or a certified or notarized Vietnamese translation of one of the following papers:

a/ Passport issued by a foreign country;

b/ Visa issued by a competent foreign agency, certifying such country’s permission for entry for overseas residence;

c/ Paper certifying such person is carrying out procedures for naturalization in a foreign country; paper certifying residence or permanent residence card or residence card of a term of 5 years or more, issued by a competent foreign agency.

4. Extract of the medical record, in the case specified at Point c, Clause 1, Article 60, or Point c, Clause 1, Article 77, of this Law.

5. For employees defined in Article 65, and Clause 5, Article 77, of this Law, a dossier for enjoyment of lump-sum social insurance allowance must comply with Clauses 2 and 3 of this Article.

According to the provisions in Appendix XIV issued with Circular 13/2019/TT-BGTVT, regulations on personal documents, tickets, and boarding passes are as follows:

Passengers with Vietnamese nationality must present one of the following documents:

Passport or travel document, separate visa, permanent residence card, temporary residence card, identity card, citizen identification card;

Identification cards and certificates of the Army;

National Assembly Delegate Card;

Party membership card;

Journalist Card;

Driving license for cars and motorbikes;

Card of the National Civil Aviation Security Committee;

Airport and aerodrome security control card with long-term use value;

Identification cards of Vietnamese airlines;

Certificate of identity confirmed by the police of the ward or commune where you permanently or temporarily reside (the confirmation has the following information:

Certifying agency, certifying person;

Date, month, year of confirmation;

Full name, date of birth, gender, hometown, permanent residence of the confirmed person;

Reason for confirmation. The confirmation has a photo attached, stamped and is only valid for 30 days from the date of confirmation);

A certificate from a competent authority certifying that the passenger has just completed serving his sentence.

Thus, according to current regulations in Vietnam, it is not stipulated that the application to receive lump-sum social insurance must include identification documents (ID card, Driver's license, ...). However, the insurance agency may request to see identification documents to compare with records. Therefore, in this case you can use a certificate of identity with the content specified above.

When can I receive lump-sum social insurance in Vietnam?

Pursuant to Article 60 of the 2014 Law on Social Insurance, regulations on lump-sum social insurance allowance are as follows:

1. Employees defined in Clause 1, Article 2 of this Law are entitled to a lump-sum social insurance allowance upon their request when falling in one of the following cases:

a/ They have reached the retirement age specified in Clause 1, 2 or 4, Article 54 of this Law but have paid social insurance premiums for under full 20 years, or the age specified in Clause 3, Article 54 of this Law but have paid social insurance premiums for under full 15 years and do not continue paying voluntary social insurance premiums;

b/ They settle abroad;

c/ They get a fatal disease, such as cancer, poliomyelitis, dropsy cirrhosis, leprosy, serious tuberculosis, or HIV infection progressing into AIDS, or other diseases as prescribed by the Ministry of Health;

d/ Employees defined at Points dd and e, Clause 1, Article 2 of this Law who are demobilized or cease working without being eligible for pension.

According to this Article, to receive lump-sum insurance, you need to belong to one of the subjects specified above in Vietnam.
