Can spouses borrow each other's health insurance cards for medical examination?
Article 37 of the 2008 Health Insurance Law stipulates the obligations of health insurance participants as follows:
- Pay health insurance premiums fully and on time.
2. Use the health insurance card for its intended purpose and do not lend it to others.
Comply with the provisions of Article 28 of this Law when visiting for medical examination and treatment.
Adhere to the regulations and guidelines of the health insurance organization and healthcare facilities when seeking medical examination and treatment.
Pay for medical examination and treatment costs not covered by the health insurance fund.
Based on the current regulations, health insurance users are not allowed to lend their health insurance cards to others. Therefore, you cannot borrow your husband's card for a medical examination.
How much can you be fined for borrowing your husband's health insurance card for a medical examination?
According to Article 84 of Decree 117/2020/ND-CP, penalties for administrative violations in using health insurance cards for medical examination and treatment are as follows:
- Monetary fines for lending a health insurance card to others or using another person's health insurance card for medical examination and treatment, imposed as follows:
a) From 1,000,000 VND to 2,000,000 VND if the violation does not cause damage to the health insurance fund;
b) From 3,000,000 VND to 5,000,000 VND if the violation causes damage to the health insurance fund.
- Measures to remedy consequences:
To return the misappropriated amount to the collection account of the health insurance fund (if any) for violations specified in point b, clause 1 of this Article.
Thus, depending on the violation, whether it caused damage or not, the fine will vary. Additionally, the violator must return the misappropriated amount to the collection account of the health insurance fund if the act caused damage to the fund.
