Vietnam: Periodical report regime of public service units

On September 16, 2022, the Minister of Finance of Vietnam issued Circular 56/2022/TT-BTC elaborating financial autonomy mechanism of public service units; handle assets and finance upon reorganization or dissolution of public service units.

According to Vietnam's Circular 56/2022/TT-BTC, the periodical report regime of public service units is prescribed as follows:

- Public non-business units implementing the financial autonomy regime must annually report the results of the financial autonomy regime to their superior management agencies (Ministries, central agencies, or People's Committees of provinces or People's Committees of districts according to management decentralization) for synthesis according to the provisions of Clause 4, Article 38 of Vietnam's Decree 60/2021/ND-CP before February 28 of the following year (according to Appendix 6).

- Ministries, central agencies, and provincial-level People's Committees shall annually evaluate the implementation of the autonomy mechanism of public administrative units according to the provisions of Clause 5, Article 36, and Clause 5 of Article 37 of Vietnam's Decree 60/2021/ND-CP. After that, the report will be sent to the Ministry of Finance before March 31 of the following year (according to Appendix 7).

- The Ministry of Finance shall make periodical reports on the implementation of the financial autonomy mechanism of public non-business units of ministries, central agencies, and localities for the management and reporting of the Government or the Prime Minister according to regulations.

- In case the Government or the Prime Minister has specific regulations on the time limit for submitting the report, the regulations of the Government or the Prime Minister shall apply.

- The time to close the data for the annual report is from January 1 to the end of January 31 of the following year.

Vietnam's Circular 56/2022/TT-BTC takes effect from November 1, 2022.
