The starting time of the labor contract in Vietnam to calculate the rent support

This is the content of the Official Dispatch 410/CVL-TTLĐ on the implementation of policies to support rent for workers in Vietnam under the Decision 08/2022/QĐ-TTg issued by the Department of Employment on 08/6/2022.

According to this Decision, the guidelines for the commencement of the labor contract in Vietnam are as follows:

- Pursuant to Clause 2, Article 8 of Decision 08/2022/QD-TTg :

In case the employee in Vietnam has had the labor contract signed and executed before April 1, 2022 but expires on March 31, 2022, continue to sign the labor contract for a second time from April 1, 2022, the dossier, order and procedures prescribed in Chapter II of Decision 08/2022/QD-TTg shall be complied with;

Employees and enterprises in Vietnam will record the commencement of the labor contract in Form 01, Form 02 issued together with Decision 08/2022 /QD-TTg as the commencement date of the labor contract that has been signed and implemented before April 1, 2022.

- Pursuant to Clause 2, Article 8 of Decision 08/2022/QD-TTg :

In case the employee in Vietnam performs training contract, probation contract in February and March 2022 and signs the labor contract with a definite term of 01 month or more, the support level, request for proposals, order and procedures shall be as prescribed in Chapter III. Assisting workers to return to the labor market.
