Criteria to establish public service provider in culture sector in Vietnam

On December 6, 2021, the Ministry of Culture, Sports and Tourism of Vietnam issued Circular 14/2021/TT-BVHTTDL stipulating classification criteria, conditions for establishment, merger, consolidation and dissolution of public service provider in culture, family, sports and tourism sector.

According to Circular, public service units in culture, family, sports and tourism sectors, must meet the criteria prescribed by law: specialized law on culture, family, sport and tourism (if any) and following establishment conditions:

- In accordance with the national sector planning or the planning on the network of public service units (if any) approved by the competent authority;

- Clearly defining the objectives, functions and tasks of the public service units, serving the state management;

- Ensuring that the minimum number of employees is 15 (except for units providing basic and essential public services).

- Having a work office or a project on land allocation for work office construction already approved by a competent authority (in case of building a new office); initial necessary equipment; human resources and operating expenses according to regulations.

- Public service units abroad: In addition to meeting the above conditions, it is necessary to ensure compliance with the foreign policy of the Communist Party and State.

Circular 14/2021/TT-BVHTTDL takes effect from February 1, 2022.
