Considering the report of the Ministry of Public Security and the National Traffic Safety Committee on the inland waterway traffic accident on February 26, 2022 on the Hoi An - Cu Lao Cham route, Hoi An city, Quang Nam province, Deputy Standing Prime Minister Pham Binh Minh asked the authorities to strengthen safety assurance for passenger transport activities on inland waterways.

The Prime Minister directs to strengthen safety assurance for passenger transport activities on inland waterways.

To ensure order and safety of inland waterway traffic in general and passenger transport from the shore to the island in particular, especially to prevent similar traffic accidents, in Official Letter No. 1439/VPCP-CN on March 7, 2022, Permanent Deputy Prime Minister Pham Binh Minh requested ministers and chairmen of People's Committees of provinces and centrally run cities to continue directing the strict implementation of the directive. Directive No.  23/CT-TTg  dated 5/7/2016 of the Prime Minister on strengthening urgent solutions to ensure traffic order and safety (TTATGT) inland waterways in the new situation; direct construction owners to organize specialized monitoring in transportation and provide hydro-meteorological information according to the provisions of the Law on Hydrometeorology and Decree No.  38/2016/ND-CP dated May 15, 2016 detailing a number of articles of the Law on Hydrometeorology, Decree No.  48/2020/ND-CP  dated April 15, 2020 amending and supplementing a number of articles of Decree No. 38/ 2016/ND-CP.

The Ministry of Transport directs the inland waterway port authorities to strengthen inspection of the observance of the law on safety, security and environmental protection of inland waterway vessels; examine certificates of professional competence and professional certificates of seafarers and vehicle drivers; resolutely not allowing the means of departure when the means of transport do not ensure safety, security and environmental protection conditions or the weather conditions are not guaranteed; attach the responsibility of the port authority if there is a particularly serious accident related to unsafe watercraft, carrying too many people or unsafe weather conditions when disembarking.

Strengthen inspection of activities at wharves and ports

The Ministry of Transport directs Traffic Inspectors to coordinate with local authorities, functional forces, and the Spring Festival Organizing Committee to intensify inspection of activities at river-crossing passenger terminals, passenger terminals, especially especially the piers, watercraft in service of tourism and festivals.

At the same time, direct the Vietnam Inland Waterway Administration, the Vietnam Maritime Administration, the Vietnam Register, the Departments of Transport of the provinces and centrally-run cities to coordinate with the functional agencies of the Ministry of Industry and Trade. Security forces, Border Guards shall inspect and correct the implementation of regulations on traffic safety assurance for infrastructure, vehicles, crew members and state management of transport activities. transporting passengers from shore to islands nationwide; handle and recommend competent authorities to handle inadequacies and violations.

Expeditiously review, supplement and complete legal provisions, a system of regulations, standards and norms related to ensuring the safety of infrastructure, vehicles, crew members and transport organizations. with inland waterway passenger transport, especially passenger transport by river and sea vehicles on routes from shore to the island.

Additional regulations on hydrometeorological monitoring 

The Ministry of Transport shall coordinate with the Ministry of Natural Resources and Environment to study and propose to supplement the regulations that ports and wharves serving passenger transport routes from shore to islands must observe hydro-meteorological observations in accordance with the Law. Hydrometeorology.

The Ministry of Natural Resources and Environment directs the General Department of Meteorology and Hydrology and the hydro-meteorological forecasting system from the central to local levels to increase the frequency of bulletins for forecasting and warning of dangerous weather at sea; strengthen forecasts and thematic warnings for transportation activities in localities with passenger transport from shore to islands and guide the use of information on forecasting and warning of natural disasters on a large scale. country.

Strictly handle violations of the law on traffic safety

The People's Committees of the provinces and centrally-run cities shall direct functional forces (Border Guards, Coast Guard, Public Security, Transport Inspectors) to strengthen inspection, patrol and control, strictly handle violations of the law on inland waterway traffic safety; In which, focus on inspecting at ports and wharves that organize passenger transport activities, especially transporting passengers from shore to islands, strictly handle violations of the law on safety. whole traffic; resolutely suspend operations of ports, wharves and wharves dealing with unlicensed tourist transport, so that the means of transport are ineligible for transport, fail to ensure safe operation within the port or wharf; do not allow disembarkation for vehicles that do not ensure safety conditions such as carrying more than the specified number of people, lacking safety equipment, life-saving, life-saving, etc. there is no specified passenger list; require business owners and individuals doing passenger transport on waterways to inspect and maintain vehicles after a long period of inactivity due to the COVID-19 epidemic before putting them into use.

Review all festivals related to water transport activities; develop and implement a plan to ensure traffic safety in inland waterways in festival areas related to inland waterway traffic activities. Scientific organization of transportation activities from ticket sales; arrange passengers on the vehicle, not to let the vehicle pull passengers, passengers jostle, push or jostle when getting on and off the vehicle; Passengers are required to use life jackets and hand-held flotation devices during their participation in inland waterway traffic.

To step up propaganda for business owners and individuals doing business in transporting passengers, crew, and people in traffic to be aware of and conscious of abiding by the law on inland waterway traffic safety; guide knowledge and skills to handle situations, rescue work when unexpected incidents or accidents occur in waterways.

Strengthen propaganda on the mass media and grassroots information systems (radio in villages, hamlets, communes and wards) on regulations on ensuring traffic safety in tourist transport activities by water transport. domestic regulations, on operating conditions of watercraft, on professional certificates for vehicle drivers, on equipment and use of life jackets, personal life-saving buoyancy devices on passenger means of transport. across the river; promptly provide information on weather forecasts, especially dangerous warning information and instructions to ensure safety for vehicles and people by authorities.

Publish the phone number of the hotline of the Department of Transport, the Waterway Police at the ports, wharves and on tourist means of transport in the province to promptly receive the feedback and recommendations of the tourists. people.

For localities with passenger transport routes from the shore to the island: Direct the competent authorities to coordinate with the Hydrometeorological Center in the locality to promptly provide weather forecasts and danger warnings. and guide to ensure the safety of people and means of transport, fishing boats and means of daily life operating in the area, especially passenger transport means.

The National Traffic Safety Committee shall monitor, urge and report to the Prime Minister on the results of the above-mentioned tasks.
