Principles of granting certificates of leave to enjoy social insurance for people with COVID-19

The Ministry of Health is collecting people's opinions on the draft Circular amending and supplementing a number of articles of Circular No. 56/2017/TT-BYT dated December 29, 2017 detailing the implementation of the Law on Insurance. Social Security (social insurance) and the Law on Occupational Safety and Health in the health sector.

The issuance of the certificate of leave of absence to enjoy social insurance must be granted by a medical examination and treatment facility that has been granted an operation license or a decision on the establishment of a COVID-19 treatment facility decided by a competent authority.

Additional draft to Article 20a on principles of granting certificates of leave to enjoy social insurance for people suffering from group A diseases (including COVID-19):

1- The grant of a certificate of leave to enjoy social insurance must satisfy the following requirements:

a) The decision to establish a medical examination and treatment facility that has been granted an operating license or a decision to establish a COVID-19 treatment facility is decided by a competent authority. Practitioners (including those assigned by competent authorities to treat COVID-19) working at medical examination and treatment establishments (including field hospitals and COVID-19 treatment facilities) ; This commune-level medical station, mobile medical station) may sign a certificate of leave to enjoy social insurance as assigned by the head of that medical examination and treatment establishment.

b/ In accordance with the scope of professional activities of the medical examination and treatment facility where the certificate of leave of absence enjoying social insurance benefits for people infected with COVID-19 has been approved by a competent authority.

c/ In accordance with the health status of the patient and the professional guidance of the Minister of Health.

d- In case the patient takes care of, manages and treats COVID-19 at home according to regulations of the Ministry of Health, the practitioner shall base on the list of COVID-19 case management in the area of ​​the commune-level health station. ; positive test results for SARS-CoV-2, determine the disease status through and follow-up information, daily disease progress of medical staff with the patient in the form of direct visit to the patient's home. or indirectly through information technology (application of telemedicine) to sign the certificate of leave of absence to enjoy social insurance as assigned by the head of that medical examination and treatment establishment.

2- Only one certificate of leave of absence for social insurance will be issued for one examination. In case the patient needs to take a leave of absence longer than 30 days, when the leave period stated on the issued leave certificate for social insurance benefits expires or is about to expire, the patient must contact the medical examination and treatment facility or the medical station that issued it. commune for the practitioner to consider and decide according to the provisions of Point d, Clause 1.

3- Practitioners working at medical examination and treatment establishments that have been granted operation licenses may sign a certificate of leave to enjoy social insurance; In case the medical examination and treatment establishment is not a legal entity, the practitioner must register a signature sample with the social insurance agency.
Tuberculosis treatment is entitled to a break of up to 180 days/time

In addition, the draft also adds Clause 2, Article 20 - Principles for granting certificates of leave to enjoy social insurance. Accordingly, only one certificate of leave of absence for social insurance will be issued for one examination. In case the patient needs to take a leave of absence longer than 30 days, when the leave period stated in the certificate of leave for social insurance benefits has expired, the patient must conduct a follow-up examination for the practitioner to consider and decide.

Particularly for the case of a patient being treated for tuberculosis under the national anti-tuberculosis program, the maximum leave time shall not exceed 180 days for a certificate of leave of absence enjoying social insurance.

In case the employee suffers a miscarriage, curettage, abortion, stillbirth, or pathological abortion from 13 weeks old or more, the maximum leave period of 50 days is for one time the certificate of leave of absence to enjoy social insurance.
