Additional cases in which no fee is charged for the issuance of construction eligibility certificates in Vietnam

Recently, the Minister of Finance of Vietnam issued Circular 38/2022/TT-BTC stipulating on amounts, collection, and payment of fees for issuance of the construction licenses and architects' practice certificates.

According to the Circular in Vietnam, the fee rates for the issuance of construction eligibility certificates are as follows:

- Fees for first-time issuance, class adjustment, and conversion in Vietnam

+ Construction eligibility certificates for organizations: 1,000,000 VND/certificate

+ Licenses to practice construction activities for individuals: 300,000 VND/certificate.

- The fee level for re-grant, supplement content, adjustment, and extension of the certificate is equal to 50% of the fee rate mentioned above.

- Fees for granting construction permits to foreign contractors: VND 2,000,000/permit.

In particular, Circular 38/2022/TT-BTC in Vietnam adds that if re-issuance of certificates and permits is issued by competent state agencies with incorrect information, no fees will be collected.

In Vietnam, fees for issuance of construction eligibility certificates for organizations, licenses to practice construction activities for individuals, architectural practice certificates, and construction licenses to foreign contractors must be paid in VND.

Circular 38/2022/TT-BTC takes effect from August 8, 2022 and replaces Circular 172/2016/TT-BTC.
