Instructions how to calculate regional minimum wages by month and hour in HCM city, Vietnam

On June 17, 2022, the General Confederation of Labor of Ho Chi Minh City, Vietnam issued Official Dispatch 516/LDLD-CSPL guiding and supervising the adjustment of the minimum wage in 2022, including instructions on how to calculate the regional minimum wage by month and hour according to the regulations

Specifically, the Standing Committee of the Ho Chi Minh City Confederation of Labor stipulates that the normal working hours-based converted monthly or hourly salary shall be subjected to the employer’s decision in accordance with regulations of law as follows:

- The converted monthly salary shall equal the product of the weekly salary and 52 weeks divided by 12 months; or the daily salary multiplied by total normal working days in a month; or the piece-rate pay or fixed pay for the works performed during normal working hours in a month.

- The converted hourly salary shall equal the weekly or daily salary divided by the normal working hours in a week or a day respectively; or the piece-rate pay or fixed pay divided by the working hours, considered as normal working hours, spent for producing a predetermined quantity of products or performing assigned works.

In addition, the Standing Board of the Ho Chi Minh City Confederation of Labor also requested specific contents such as:
- When adjusting the monthly minimum wage and the minimum hourly wage for employees working under labor contracts working for regional employers, enterprises are not allowed to cut or reduce any overtime pay, nightshift pay, perquisites and other benefits paid to employees as prescribed by the Labour Code

For allowances, subsidies, bonuses, etc., prescribed by enterprises, they shall follow agreements in contracts, collective labor agreements or in the enterprise's regulations as prescribed by law;

- In addition to adjusting the minimum wage, enterprises are not allowed to lower the current wage level of employees and still have to ensure the implementation of the regulation on periodic salary increase as agreed in the labor contract, collective labor agreement or in the regulations of the enterprise;

- After Executive Committee of Grassroots Trade Union of Vietnam agreed with the enterprise and the adjustment of the monthly minimum wage and the minimum hourly wage by region, they shall public the information and let the employees know and coordinate with the enterprise to adjust the wage in the labor contract accordingly.
