The Government has issued Decree 17/2022/ND-CP amending a number of decrees on administrative sanctions in the field of chemicals and industrial explosives; electricity, etc., in which, inn owners who collect electricity bills higher than the prescribed price may be fined up to 30 million VND.

Specifically, in Clause 15, Article 2 of Decree 17/2022/ND-CP stipulates:

A fine ranging from VND 20-30 million shall be imposed on the lessor who collects electricity from the tenant higher than the prescribed price in the case of purchasing electricity at the retail price to serve the purposes of daily life, production, business and service. service.

(Previously, the fine for this act was from 10-15 million VND)

In addition, the lessor who collects the tenant's electricity bill higher than the prescribed price will also be subject to the remedial measure of being forced to pay back the illegal profits obtained from committing the violation (including including all costs incurred due to violations) to reimburse the appropriated individuals and organizations.

In addition, Decree 17/2022/ND-CP also stipulates a sharp increase in penalties for a number of violations on electricity use, specifically:

- A fine of 2-3 million dong for obstructing the competent person to inspect the use of electricity.

- A fine of between VND 3-5 million for the following acts:

+ Unintentionally causing trouble to the electricity seller's electrical system.

Arbitrarily supplying electricity to other organizations and individuals.

- A fine of between VND 5-8 million for acts of arbitrarily installing, closing, cutting, repairing, moving and replacing electrical equipment and electrical works of the electricity seller.

(Previously, the fine for this behavior was from 2-4 million VND)

- A fine of between VND 8-10 million shall be imposed for voluntarily switching on electricity for use when the electricity-using works of the electricity buyers have not been tested and accepted, while the power supply is stopped due to violations of the law.

- A fine of between VND 10-14 million for one of the following acts:

+ Causing damage, arbitrarily moving the electricity metering system (including meter protection cabinets, seals and wiring devices).

+ Using equipment for the purpose of causing interference to damage data transmission, measurement and protection equipment of the power system.

(Previously, the fine for this behavior was from 5 to 7 million VND)

- A fine of between VND 60-80 million for one of the violations committed by large electricity users:

+ Failure to comply with the electricity usage regime at the required level of the national power system dispatching unit in case the system's capacity is limited; there is no measure to ensure the voltage standard agreed in the power purchase agreement.

+ Using electricity-using equipment, connection equipment that does not meet technical standards and regulations promulgated by competent state agencies to connect to the national electricity grid.

+ Failing to perform the operation commands of the national power system dispatching unit.

+ Do not cut power, reduce electricity consumption at the request of the electricity seller due to force majeure events.

+ Failing to invest in communication systems, SCADA/EMS/DMS, power metering according to regulations. (New content added)

+ Failing to maintain the normal operation of the communication system, SCADA/EMS/DMS, metering and metering of the invested power according to regulations. (New content added)

Note: The above sanction applies to individuals; In case of violations by organizations, the fine level is 2 times that of individuals.

Decree 17/2022/ND-CP takes effect from January 31, 2022.
