The Government has just issued Decree 11/2022/ND-CP amending and supplementing Decree 103/2020/ND-CP on certification of aromatic rice varieties exported to the European Union to guide the implementation of certification. fragrant rice varieties exported to the European Union and the United Kingdom of Great Britain and Northern Ireland, effective from January 15, 2022.

Accordingly, there are a number of new regulations on certification of aromatic rice varieties as follows:
1. About the application for certification of aromatic rice varieties
In Clause 3, Article 1 of Decree 11/2022 amending and supplementing Point b, Clause 1, Article 7 of Decree 103/2020/ND-CP on the form of Certificate of aromatic rice varieties, specifically as follows:
The form of Certificate of aromatic rice variety is fully declared from items 1 to 9 according to the form specified in Appendix VI issued with Decree 103/2020 for fragrant rice exported to the EU or Appendix VIa. promulgated together with Decree 11/2022/ND-CP for fragrant rice exported to the UK.
(Previously, it was only stipulated that the Form of Certificate of aromatic rice variety must fully declare information from items 1 to 9 according to the form specified in Appendix VI issued with Decree 103/2020 ).
Thus, the new regulation has clearly defined the form of Certificate of aromatic rice varieties for fragrant rice exported to the EU and for fragrant rice exported to the UK.
In addition, other dossier components are the same as previously prescribed, including:
- An application form for certification of aromatic rice varieties according to the form specified in Appendix V issued with Decree 103/2020 .
- The original or a certified true copy of the inspection record of the fragrant rice field plot according to the form specified in Appendix II issued together with Decree 103/2020 ;
- Written agreement on transfer of Minutes of inspection of fragrant rice fields in case organizations or individuals requesting certification of aromatic rice varieties are not named in the Minutes of inspection of fragrant rice fields.
2. About the order of certification of fragrant rice varieties
- Organizations and individuals submit 01 set of dossiers directly or via postal service or via electronic environment to the Department of Crop Production.
*In case of direct submission or by postal service:
The Department of Crop Production checks the composition of the dossier and immediately responds to the completeness of the dossier to the organization or individual.
* In case of submission via the electronic environment: The application components must be declared and signed digitally on the provided electronic forms according to the provisions of Clauses 1 and 2, Article 9 of Decree No. 45/2020/ND - CP .
Within no more than 01 working day from the date of receipt of the dossier, the Department of Crop Production shall consider the completeness of the dossier components; in case the dossier is incomplete as prescribed, notify in writing the organization or individual;
- Within 05 working days from the date of receiving the valid application, the Department of Crop Production shall appraise and certify in section 10 of the certificate of aromatic rice varieties specified in Appendix VI issued with Decree No. Decree 103/2020/ND-CP for fragrant rice exported to the EU or Appendix VIa issued together with Decree 11/2022 for fragrant rice exported to the UK; In case of non-certification, a written reply must be given clearly stating the reason.
3. About the application for re-certification of fragrant rice varieties
In Clause 5, Article 1 of Decree 11/2022 amending and supplementing the form of re-certification of aromatic rice varieties as follows:
The form of re-certificate of aromatic rice varieties is fully declared from items 1 to 9 according to the form specified in Appendix VII issued together with Decree 103/2020/ND-CP for fragrant rice exported to Vietnam. EU or Annex VIIa promulgated together with Decree 11/2022 for fragrant rice exported to the UK.
(Previously, only the form of Certificate of aromatic rice variety must be fully declared from items 1 to 9 according to the form specified in Appendix VII issued together with Decree 103/2020. )
4. Addendums VIa, VIIa
Decree 11/2022 adds 02 appendices:
- Appendix VIa on the form of certificate of aromatic rice varieties for fragrant rice exported to the UK;
- Appendix VIIa on the form of re-certification of aromatic rice varieties for fragrant rice exported to the UK.
5. Replace Appendix V issued with Decree 103/2020/ND-CP with Appendix V issued together with Decree 11/2022
6. Annulling Appendix I issued together with Decree 103/2020/ND-CP
Note: Aromatic rice produced before January 15, 2022 for export to the UK, the application for certification of aromatic rice varieties of organizations or individuals must comply with Point a, Clause 1, Article 7 of Decree 103/ 2020/ND-CP and Clause 3, Article 1 of Decree 11/2022 ; Dossier of application for re-certification of aromatic rice varieties shall comply with Point a, Clause 2, Article 8 of Decree 103/2020/ND-CP and Clause 5, Article 1 of Decree 11/2022 until the end of March 31, 2022.
