Who settles denunciations with violations in the performance of official duties by civil servants in Vietnam?
1. Rules for settling denunciations
- Denunciation settlement must be conducted promptly, accurately, objectively and according to competence, order, procedures and time limit prescribed by law.
- The denunciation settlement must ensure the safety for the denouncer and the lawful rights and interests of the denounced party in the process of denunciation settlement.
Thus, the denunciation shall be settled on the basis of timeliness, accuracy and lawfulness.
2. Competence to settle denunciations of law violations in the performance of tasks and official duties in state administrative agencies in Vietnam
2.1 Competence of commune-level People's Committee presidents to settle denunciations in Vietnam
Commune-level People's Committee presidents are competent to settle denunciations of violations committed while performing official duties by civil servants under their direct management.
2.2 Competence of district-level People's Committee presidents to settle denunciations in Vietnam
- Settle denunciations of violations against the law committed by the President or Deputy President of People's Committee of the commune, and other officials and public employees appointed by the President or under his/her management during performance of their duties;
- Settle denunciations of violations against the law committed by organizations under the management of the People's Committee of the district during performance of their duties.
2.3 Competence to settle denunciations of heads of specialized agencies under provincial-level People's Committees in Vietnam
- Settle denunciations of violations against the law committed by the head or deputy head of the affiliate, and other public officials and public employees appointed by the head of the organization or under his/her management during performance of their duties;
- Settle denunciations of violations against the law committed by organizations under his/her management during performance of their duties.
2.4 Competence of provincial-level People's Committee presidents to settle denunciations in Vietnam
- Settle denunciations of violations against the law committed by the President or Deputy President of the People's Committee of the district, head or deputy head of the specialized agency affiliated to the People's Committee of the province, and other public officials and public employees appointed or under his/her management during performance of their duties;
- Settle denunciations of violations against the law committed by organizations under the management of the People's Committee of the province during performance of their duties.
2.5 Competence to settle denunciations of General Directors, Directors of Departments or equivalent levels under ministries or ministerial-level agencies who are decentralized to manage cadres, civil servants and public employees in Vietnam
- Settle denunciations of violations against the law committed by the head or deputy head of the affiliate of the General Department, Department or equivalent level, and other public officials and public employees appointed by the head of the ministerial agency or under his/her management during performance of their duties;
- Settle denunciations of violations against the law committed by organizations under his/her management during performance of their duties.
2.6 Competence to settle denunciations of heads of government-attached agencies in Vietnam
- Settle denunciations of violations against the law committed by the head or deputy head of the affiliate of the Governmental agency, and other public officials and public employees appointed by the head of the Governmental agency or under his/her management during performance of their duties;
- Settle denunciations of violations against the law committed by organizations under his/her management during performance of their duties.
2.7 Competence of ministers and heads of ministerial-level agencies to settle denunciations in Vietnam
- Settle denunciations of violations against the law committed by the head or deputy head of the affiliate of the Ministry or ministerial agency, and other officials and public employees appointed by the head of the ministerial agency or under his/her management during performance of their duties;
- Settle denunciations of violations against the law committed by organizations under his/her management during performance of their duties.
2.8 Competence to settle denunciations of the Prime Minister in Vietnam
- Settle denunciations of violations against the law committed by Ministers, Deputy Ministers, heads or deputies of heads of ministerial-level agencies or Governmental agencies, Presidents or Deputy Presidents of People's Committees of provinces, and other officials, public servants and public employees appointed or under his/her management during performance of their duties;
- Settle denunciations of violations against the law committed by organizations under his/her management during performance of their duties.
