Can a party member who asked to leave the Communist Party of Vietnam be re-admitted?

1. Who are the Party members? 

According to Clause 1, Article 1 of the Charter of the Communist Party of Vietnam, a party member is a revolutionary soldier in the vanguard of the working class, the toiling people, and the Vietnamese nation, striving all his life for the goals and ideals of the Vietnamese people. of the Party, putting the interests of the Fatherland, the working class, and the working people above personal interests;

Strictly abide by the Political Platform, the Party Charter, the Party's resolutions and the State's laws; have employees; successfully complete the assigned tasks; have morals and a healthy lifestyle; closely associated with the people; obey the Party's organization and discipline; and maintain unity and unity in the Party.

2. When are party members allowed to leave the Party?

According to Vietnam's Instruction 01-HD/TW dated September 28, 2021, only Party members who have not violated their eligibility will be considered for leaving the Party. If they violate the Party membership, they must be disciplined by the Party, and then they will be considered to leave the Party.

3. Can a party member who has applied to leave the party be re-admitted? 

According to Vietnam's Regulation 24-QD/TW dated July 30, 2021 on the re-admission of people to the Party as follows:

* Persons who are considered for re-admission must fully meet the following conditions:

- Having full conditions and criteria for people to join the Party as prescribed in Article 1 of the Charter of the Communist Party of Vietnam:

+ A member of the Communist Party of Vietnam is a revolutionary soldier in the vanguard of the working class, the toiling people, and the Vietnamese nation. All his life, he strives for the Party's purposes and ideals, putting the interests of the people in charge. The fatherland, the working class and the working people take precedence over personal interests;

Strictly abide by the Political Platform, the Party Charter, the Party's resolutions and the State's laws; have employees; successfully complete the assigned tasks; have morals and a healthy lifestyle; closely associated with the people; obey the Party's organization and discipline; and maintain unity and unity in the Party.

+ Vietnamese citizens of eighteen years of age or older; recognize and voluntarily: implement the political platform, party charter, standards, and duties of party members; participate in a grassroots party organization;Through practice, they have proven themselves to be excellent people, trusted by the people, and can be considered for admission to the party.

- At least 36 months since leaving the Party (particularly for people who have criminal convictions for less serious crimes, it must be 60 months after their criminal records are expunged; Party members who have been removed from the Party due to violations of the policy on population and family planning shall comply with the regulations of the Secretariat); they are allowed to make an application for re-admission to the Party;

It must be approved in writing by the standing committee of the provincial or municipal Party Committee (or equivalent) and considered and decided by the competent party committee (district party committee and equivalent).

- Strictly follow the procedures mentioned in Clauses 1, 2, 3, and Article 4 of the Charter of the Communist Party of Vietnam:

+ Members of the party must

++ Have a voluntary application for membership in the party;

++ Provide accurate background information to the branch;

++ Officially introduced by two members of the party.

Where the Ho Chi Minh Communist Youth Union is organized, those entering the Party at a young age must be union members and be introduced by the grassroots executive committee and an official party member.

In agencies and enterprises where there is no organization of the Ho Chi Minh Communist Youth Union, people who join the party must be trade unionists, be introduced by the grassroots trade union executive committee, and be an official party member.

+ The referee must:

++ Being an official member of the party and working together with the person joining the Party for at least one year;

++ Report to the branch on the background, qualities, and capacity of the person entering the Party and take responsibility for his/her introduction. If there is anything unclear, report it to the branch and superiors for consideration.

+ Responsibilities of branches and committees

++ Before the Party cell considers and proposes admission, the Party Committee re-examines the conditions of the person's joining the Party and collects opinions and comments from the mass organizations where such a person lives.

The issue of the political history of people entering the Party must comply with the regulations of the Central Committee.

++ The Party cell considers and proposes to admit each person one by one. When at least two-thirds of the official members of the Party cell approve, it proposes to the higher level of the Party Committee; when there is a decision by the superior party committee, the branch will organize the admission ceremony one by one.

++ The grassroots Party Committee considers that, if at least two-thirds of the members at all levels agree to admit it, it will be proposed to the immediate superior level of the Party Committee.

++ The Standing Committee of the Party Committee at the immediate superior level of the Party's grassroots organization or the grassroots party committee is authorized to consider and decide on admission one by one.

* Subjects not considered for re-admission:

Not considering and re-admitting those who previously left the Party for the following reasons: quitting party activities; making an application to join the Party (except in the case of special family difficulties); causing serious internal disunity; being convicted of corruption; being convicted of a serious crime or more.

* Only re-enroll once.

* Re-admitted party members must undergo a probationary period.

Thus, a party member after applying to leave the Party can be re-admitted if he meets the prescribed conditions and can only be re-admitted once.

4. Procedures for party members seeking to leave the party

Procedures for applying to leave the Party for Party members according to Vietnam's Instruction 01-HD/TW dated September 28, 2021 are as follows:

- Party members who want to leave the Party must make an application, clearly stating the reason for leaving the Party, and report to the cell.

- Branches, divisional party committees (if any), and grassroots Party committees to consider and report to competent Party committees for consideration and decision to leave the party and carry out procedures to remove names from the list of party members.

- The Grassroots Party Committee, authorized to admit or expel Party members, shall issue a decision to remove names from the list of party members.

Party members who have been decided by a competent party committee to leave the party; if they wish to be granted a certificate of party age, the competent party committee shall consider and issue such persons a "certificate of party age."
