Transport business is a conditional business line. One of the conditions of transport business is to install surveillance cameras. what are the penalties for not installing or installing surveillance cameras not in accordance with the regulations in Vietnam?

1. Transport business vehicles must have surveillance cameras installed in Vietnam

According to Clause 2, Article 13, Clause 2, Article 14 of Decree 10/2020/ND-CP of Vietnam:

- Tourist automobiles and passenger automobiles having fewer than 09 seats (including the driver) and operating under electronic contracts shall have a service life of 12 years

-  Tractor trucks and tractor units must be equipped with cameras to record images of the driver driving. 

2. What are the fines for transport business vehicles without surveillance cameras in Vietnam?

* A fine ranging from VND 1,000,000 to VND 2,000,000 shall be imposed on operators of trucks, tractors (including trailers and towed semi-trailers) and or car-like vehicles transporting goods violating traffic rules:

- Operating a vehicle providing goods transportation services without installing tracking devices on the vehicle as per the law, 

- Failure to use driver identification cards to input information as per the law or using driver identification cards of other drivers to input information when operating vehicle for goods transportation;

- Employing technical measures, peripherals or other measures to falsify data from cameras installed on the vehicle

* A fine ranging from VND 5,000,000 to VND 6,000,000 shall be imposed on individuals, from 10,000,000 VND to 12,000,000 VND for transport service, transport auxiliary service violating traffic rules:

- Operating a vehicle providing transportation services without installing cameras as prescribed (if required by the law);

- Installing cameras without ability to record and store images on the vehicle (including the driver and the vehicle doors) during the vehicle's operation as prescribed;

- Employing technical measures, peripherals or other measures to falsify data from cameras installed on the vehicle;

- Failure to provide, update, transmit, store and manage images from cameras installed on the motor vehicle as prescribed, failure to grant accounts used to access their servers to competent authorities as prescribed.
