Additional conditions for opening childcare classes at home from February 15, 2022

The Minister of Education and Training promulgates Circular 49/2021/TT-BGDĐT on the Regulation on organization and operation of independent children's groups, independent kindergarten classes, and independent preschool classes of both private and public types. Accordingly, additional conditions for organizing independent children's groups (homecare classes) from February 15, 2022 are added.

1. For groups of independent children with a maximum size of 07 children

According to Article 8 of Circular 49/2021 , the organization of independent children's groups (homecare classes) is as follows:

- Children in the group of independent children with a maximum size of 07 children aged from 3 months to 36 months.

- A person who nurtures, cares for and educates children may directly nurture, care for and educate up to 02 children aged from 3 to 12 months old or up to 3 children from 12 to 36 months old.

- Each group of children has no more than 01 disabled child. (New content added)

2. For groups of independent children over 07 children:

According to Article 14 of  Circular 49/2021  stipulating the organization of independent children's groups (homecare classes) with a size of more than 7 children as follows:

- Children from 3 months old to 36 months old are organized into groups of children. The maximum number of children in a group of children is specified as follows:

+ Group of children from 3 to 12 months old: 12 children;

+ Group of children from 13-24 months old: 20 children;

+ Group of children from 25 - 36 months old: 25 children.

- If the number of children in each group of children or kindergarten is not enough 50% of the maximum number of children specified at Points a and b, Clause 1 of Article 14 of Circular 49/2021/TT-BGDĐT , the organization may organize into a group of children with no more than 20 children, or a pre-school class with no more than 30 children, or a pre-school class with no more than 22 children.

- Each group of children or kindergarten has no more than 01 children with disabilities learning inclusion. (New content added)

- In places where there are not enough children to arrange in groups of children or kindergarten classes as prescribed in Clause 1 of Article 14 of Circular 49/2021 , the norm of preschool teachers will be calculated on the average number of children according to each age of each age group. group of children, kindergarten, specifically:

+ For group of children: 01 teacher to nurture, care for and educate 03 children aged 3-12 months or 08 children aged 13-24 months or 10 children aged 25-36 months.

+ For kindergarten class: 01 teacher nurtures, takes care of and educates 11 children aged 3-4 years old or 14 children aged 4-5 years old or 16 children aged 5-6 years old.

- Each group of children, kindergarten class has at least 02 teachers.

In addition, Circular 49/2021 also stipulates the following criteria for young group owners:

- Be a citizen of the Socialist Republic of Vietnam;

- Good moral qualities;

- Under 65 years old; (New content added)

- Good healthy;

- Have a high school diploma or higher. (Currently, it is stipulated that having a high school diploma or higher; having a certificate of professional training in management, care, nurturing and education of children or a certificate of training for educational administrators as prescribed) .

Circular 49/2021/TT-BGDDT takes effect from February 15, 2022.
