Notable legal documents of Vietnam last week (27/6 - 3/7, 2022)

1. Update on 05 Laws which were approved by the National Assembly of Vietnam at the 3rd Session, XV National Assembly

Specifically, 05 Laws which were approved by the National Assembly at the 3rd Session of the XV National Assembly, include:

- Cinematography Law 2022 takes effect from January 1, 2023.

- Law on Insurance Business 2022 takes effect on January 1, 2023.

- The amended Law on Intellectual Property 2022 takes effect from January 1, 2023.

- The Law on Mobile Police 2022 takes effect on January 1, 2023.

- The Law on Emulation and Commendation 2022 takes effect on January 1, 2024.

2. Pilot organization for inmates to work outside detenion center in Vietnam

Resolution 54/2022/QH15 stipulates the pilot model of organizing labor activities, vocational guidance and vocational training for inmates outside detention center.

According to the Resolution, the pilot model of organizing labor activities, vocational guidance and vocational training for inmates outside detention center has some outstanding points as follows:

- The pilot will be implemented from September 1, 2022 and will take effect for 5 years.

- Detention centers may pilot cooperation with Vietnam's organizations to organize labor, vocational guidance and vocational training activities for inmates outside detention center

- The number of inmates to be piloted should not exceed one-third of the total number of inmated under the Ministry of Public Security of Vietnam.

The list of inmates to be piloted shall be decided by the Ministry of Public Security on the basis of principles and criteria prescribed by the Government of Vietnam

3. Forms of exploiting database on housing and real estate market in Vietnam

The forms of exploitation and use of database on housing and real estate market are prescribed in Decree 44/2022/ND-CP, including:

- Via the portal of information system on housing and real estate market (http://www.batdongsan.xaydung.gov.vn); Portal of the Department of Construction;

- Through the request form or written request;

- By a contract between the agency managing the information system on housing and real estate market and the party exploiting and using data on housing and real estate market in accordance with the law.

Decree 44/2022/ND-CP takes effect on August 15, 2022 and replaces Decree 117/2015/ND-CP.

4. Fully annulling the regulation of foreign language certificates by grade for administrative officials

Circular 06/2022/TT-BNV (effective from August 15, 2022) amends Circular 2/2021/TT-BNV on codes, professional standards, professional and salary classification for the ranks of civil servants specialized in administration and civil servants specialized in clerical work.

Specifically, in the standards of professional and professional competence for the ranks of experts, key specialists, and senior specialists in administration, it is no longer required to have foreign languages ​​at a level equivalent to levels 3 and 4 compared to the current regulations

Instead, only skills in using foreign languages ​​or using ethnic minority languages ​​are required for civil servants working in ethnic minority areas according to the requirements of the job position.
