Penalties for building houses on agricultural land in Vietnam

As defined by Law of the Land< /a>, the conversion of agricultural land use purpose to residential land must be approved by a competent state agency. However, many people still build houses on agricultural land (arbitrarily changing the purpose of using agricultural land to residential land without permission from the competent state agency). So what is the penalty for this behavior in Vietnam?

Pursuant to the provisions of Articles 9, 10 and 11 of Decree 91/2019/ND-CP of Vietnam, the act of arbitrarily changing the purpose of using agricultural land to residential land (specifically, building houses on agricultural land) without not authorized by the competent state agency will be sanctioned. Depending on the type of land, the area of ​​the violation and the subject of the violation (either an organization or an individual), the fine can range from VND 3 million to VND 1 billion. As follows:

In addition to being fined according to the above-mentioned level, the land user is also required to restore the original state of the land before the violation (except for the case of compulsory registration of land according to regulations for cases where all conditions are met for recognition of land use rights as prescribed in Article 22 of Decree 43/2014/ND-CP). At the same time, forced to return illegal profits obtained from committing violations according to the provisions of law.

Note: The above is the fine level applied to individuals; the fine level for organizations is equal to 02 times the fine level for individuals having the same violation act. That is, organizations that arbitrarily change the purpose of using agricultural land to residential land without the permission of a competent state agency may be fined up to 1 billion VND.
