Cases of Citizen ID card being revoked and detained in Vietnam

Citizens aged 14 years or older are granted citizen ID card in Vietnam. However, in some cases below, their citizen ID card may be detained or even revoked.

1. In what cases shall Citizen ID card be revoked Vietnam?

According to the provisions of Clause 1, Article 28 of the Law on Citizen Identification, citizen’s identity card shall be revoked in case of deprivation or renunciation of Vietnamese nationality or annulment of the decision on naturalization in Vietnam.

2. 02 cases of Citizen ID card being temporary seized in Vietnam

A citizen’s identity card shall be temporarily seized in the following cases:

- A person serving a decision to send him/her to a reformatory, a compulsory educational institution or a compulsory detoxication establishment;

- A person being in custody or temporary detention, or serving an imprisonment sentence.

Note: When citizen’s ID card shall be temporarily seized, citizens are allowed by the CCCD card custody agency to use their citizen’s ID card to make transactions in accordance with the law.

Citizens may reveive their citizen’s ID card back upon the expiration of the term of custody or temporary detention, completion of their prison sentence, or completion of the decision to send them to reformatory, compulsory educational institution, or compulsory rehab establishment.

3. Authority to revoke and temporarily seize citizen’s ID card in Vietnam

- Competent citizen identification management agencies may revoke citizen’s identity cards in case of deprivation or renunciation of Vietnamese nationality or annulment of the decision on naturalization in Vietnam;

- Agencies executing custody or temporary detention warrants, agencies executing imprisonment sentences or decisions to send citizens to reformatories, compulsory educational institutions or compulsory detoxication establishments may temporarily seize citizen’s identity cards in the cases specified in Clause 2 of Article 28.
