To allocate and assign cost estimates for implementing preferential policies for people with meritorious services in Vietnam

Circular 44/2022/TT-BTC stipulates the management and use of recurrent expenditures for the implementation of policies and preferential regimes for people with meritorious services to the revolution, relatives of people with meritorious services to the revolution, and people directly participating in the resistance war under the management of the Labor-Invalids and Social Affairs sector, effective from September 5, 2022.

Specifically, the allocation and assignment of budget estimates for the implementation of preferential policies for people with meritorious services are as follows:

(1) Based on the state budget estimate assigned by the Prime Minister, the Ministry of Finance of Vietnam assigns the budget estimate for implementation of preferential policies for people with meritorious services to the revolution to the Ministry of Labor, War Invalids, and Social Affairs of Vietnam:

- Preferential allowances under the Ordinance on Incentives for people with meritorious services to the revolution and the Ordinance on Heroic Vietnamese Mothers, including:

+ Allowance, regular allowance, and one-time allowance expenses;

+ Expenses for the provision of assistive devices, orthopedic tools, rehabilitation, treatment, and nursing means and equipment;

+ Expenses for work (in which details: grave work, martyrs' cemetery; support for fostering and nursing facilities; management expenses).

- Payment of lump-sum allowances according to the Ordinance on Heroic Vietnamese Mothers and the Government's Decrees and the Prime Minister's Decision for young volunteers and people participating in the resistance war.

(2) The Ministry of Labor, War Invalids, and Social Affairs of Vietnam shall allocate and assign estimates to the Departments of Labor, War Invalids, and Social Affairs detailing spending tasks by December 25 of the previous year, based on the assigned estimates.

At the same time, it authorizes the Departments of Labor to allocate and assign estimates to budget-using units (agencies and units assigned to manage and use the funds of people with meritorious services to the revolution), establishments for nurturing, nursing, and welcoming people with meritorious services to the revolution, and expenses at the Department of Labor-Invalids and Social Affairs) before December 31 of the previous year; send it to the Ministry of Finance or the State Treasury where the transaction is located for implementation;

Dossiers and documents to be sent to the Ministry of Finance of Vietnam include:

- Explanation of basis and distribution report;

- For works supporting the construction of new martyrs' graves, including stele inscribed with the names of martyrs (not associated with the project of building or upgrading the cemetery); support to renovate, upgrade, and repair martyrs' graves, including the stele inscribed with the martyr's name; Dossiers and documents specified at Point b, Clause 5, Article 152 of Decree 131/2021/ND-CP;

- For projects supporting the renovation, upgrading, repair and maintenance of nursing, nurturing, and welcoming establishments for people with meritorious services to the revolution: Dossiers and documents specified at Point b, Clause 2 of this Article 134 of Decree 131/2021/ND-CP.

(3) Within 10 working days of receiving the allocation report from the Ministry of Labor, War Invalids, and Social Affairs, the Ministry of Finance shall check the estimates that the Ministry of Labor, War Invalids, and Social Affairs of Vietnam has issued a decision to assign to the Departments of Labor, War Invalids, and Social Affairs.

In the case of detecting improper allocation of the total and detailed levels of each task within the assigned budget estimates, if the application is not in accordance with the prescribed policies and regimes, the explanation documents are incomplete, the Ministry of Labor, War Invalids, and Social Affairs is requested to amend and supplement the dossier.

The time for the Ministry of Labor-Invalids and Social Affairs of Vietnam to adjust and supplement the dossier is within 07 working days from the date of receipt of the request from the Ministry of Finance of Vietnam. 

(4) In the case of being assigned additional estimates, within 10 working days from the date of being assigned additional estimates, the Ministry of Labor, War Invalids, and Social Affairs, the Department of Labor, War Invalids, and Social Affairs must complete the allocation and assign the cost estimates to the units according to regulations.
