Authority, procedures to mobilize civil servants in Vietnam

Mobilizing civil servants means the transfer of civil servants by a competent agency's decision from one agency, organization or unit to another in Vietnam.

Mobilization of civil servants is prescribed in Article 50 of the Law on Cadres and Civil Servants (2008) and Article 26 of Decree 138/2020/ND-CP, specifically as follows:

1. Cases of transfer of civil servants in Vietnam

The mobilization of civil servants shall be carried out in the following cases:

- According to task requirements;

- According to master plans and plans on civil servant employment in agencies and organizations, as well as between agencies and organizations, as determined by competent agencies;

- Changing the working position according to the party's regulations and the law.

2. Power to mobilize civil servants in Vietnam

Heads of agencies or organizations assigned or decentralized to manage civil servants shall decide on the mobilization of civil servants under their management or submit them to competent authorities for decision in accordance with the law.

3. Procedures for civil servant transfer in Vietnam

The order and procedures for dispatching civil servants are prescribed as follows:

- Based on the planning, work needs, capacity, and forte of civil servants, heads of agencies and organizations assigned or decentralized to manage civil servants shall develop plans and measures to mobilize civil servants under their management. management scope, reporting to competent authorities for consideration and decision on implementation;

- Make a list of civil servants to be dispatched;

- Specific implementation measures for each case;

- For civil servants holding leadership and management positions, the order and procedures for mobilization shall be carried out as in the case of appointing leading and managing civil servants from other human resources as prescribed in Clause 3, Article 46 of the Decree. 38/2020/ND-CP.

Note: Before deciding to mobilize civil servants, the head of the agency assigned or decentralized to manage civil servants should meet with the civil servant to clearly state the purpose and necessity of the mobilization.

They are to listen to civil servants' suggestions before making decisions according to their competence or reporting them to competent authorities for consideration and decision.
