Will motorcyles in Vietnam required to undergo mandatory emission testing from January 01, 2025? What documents must be carried when operating a motorcycles in Vietnam?

Emissions from transportation vehicles are currently one of the main causes of environmental pollution in Vietnam. The Vietnam Road Traffic Order and Safety Law 2024 has stipulated the control of emissions for motorcycles.

1. Will motorcyles in Vietnam required to undergo mandatory emission testing from January 01, 2025?

Article 42 of the Vietnam Road Traffic Order and Safety Law 2024 stipulates as follows:

- Motor vehicles and special-use motor vehicles participating in road traffic must be inspected according to the provisions of the law.

- The inspection for motorcycles and mopeds shall only include emissions testing. Emissions testing shall be carried out in accordance with environmental protection regulations and performed at emissions testing facilities that meet national technical standards.

- The inspection of technical safety and environmental protection of motor vehicles and special-use motor vehicles shall be carried out by inspection officers of the inspection facilities, which will then issue inspection certificates.

Thus, in Vietnam, from January 1, 2025, motorcycles will undergo emissions testing according to environmental protection regulations. Emissions testing will be conducted at emissions testing facilities that meet national technical standards in Vietnam.

However, not all motorcycles in Vietnam will undergo emissions testing from January 1, 2025, but this will be implemented according to a timetable set by the Government of Vietnam.

2. From January 1, 2025, what documents must be carried when operating a motorcycles in Vietnam?

According to Article 56 of the Vietnam Road Traffic Order and Safety Law 2024:

Article 56. Conditions for driving vehicles participating in road traffic

1. Drivers participating in road traffic must meet legal age and health requirements; must have a valid driving license with available points matching the type of vehicle being driven, issued by a competent authority, except for drivers of mopeds as specified in Clause 4 of this Article. When participating in road traffic, the driver must carry the following documents:

a) Vehicle registration certificate or a certified copy of the vehicle registration certificate accompanied by the original of the valid document issued by the credit institution or foreign bank branch in case the vehicle is mortgaged at such institution or branch;

b) Valid driving license appropriate for the type of vehicle being driven;

c) Inspection certificate of technical safety and environmental protection for motor vehicles as required by law;

d) Compulsory civil liability insurance certificate of the motor vehicle owner.

In Vietnam, from January 1, 2025, when riding a motorcycle, the driver must carry the following documents:

(1) Vehicle registration certificate or a certified copy of the vehicle registration certificate accompanied by the original document issued by the bank in case the vehicle is mortgaged at the bank;

(2) Valid motorcycle driving license;

(3) Inspection certificate of technical safety and environmental protection;

(4) Compulsory civil liability insurance certificate.

Additionally, motorcycle drivers must meet the legal age and health requirements; understand road traffic rules, and possess the necessary skills to operate the vehicle in road traffic.

In cases where the documents required when participating in traffic have been integrated into the electronic identification account, the presentation and inspection of these documents can be carried out through the electronic identification account.

For learner drivers and candidates undergoing driving tests, practicing on the test route must have a driving instructor or examiner present. The instructor or examiner must carry the aforementioned documents.
