What is the penalty for using a phone while driving motorcycles in Vietnam in 2025?

Based on point đ, clause 4, Article 7 of Decree 168/2024/ND-CP issued by the Government of Vietnam, provisions for penalties and license points deduction for motorcycle operators violating road traffic rules are as follows:

c) Overtaking in prohibited situations, overtaking on sections of the road with signs indicating overtaking is prohibited for the vehicle type being operated, except for violations stated in point đ, clause 3 of this Article;

d) Making a U-turn in a tunnel;

dd) A driver using an umbrella (parasol), audio devices (except hearing aids), holding and using a phone or other electronic devices.

Thus, the penalty for using a phone or other electronic devices while riding a motorcycle in 2025 is from 800,000 VND to 1,000,000 VND.

Additionally, violators who hold and use a phone while riding may have 04 points deducted from their driving license (according to point b, clause 13, Article 7 of Decree 168/2024/ND-CP).

What is the penalty for using a phone while driving cars in Vietnam in 2025?

The penalties for using a phone while driving a car in 2025 are stipulated in point h, clause 5, point b, clause 10, Article 6 of Decree 168/2024/ND-CP as follows:

10. A fine ranging from 20,000,000 VND to 22,000,000 VND is imposed on drivers committing one of the following violations:

b) Violating the provisions of one of the points, clauses of this Article causing traffic accidents: point a, point b, point c, point d, point dd, clause 1; point c, clause 2; point b, point g, point h, point n, point o, point p, clause 3; point a, point c, point d, clause 4; point c, point d, point e, point h, point n, point o, point q, clause 5; point b, clause 7; point b, point c, point d, clause 9 of this Article.

From 2025, the penalty for using a phone or other electronic devices while driving a car will be from 4,000,000 VND to 6,000,000 VND. In cases where the violation causes a traffic accident, the penalty will increase to 20,000,000 VND to 22,000,000 VND.

Additionally, under point b, point d, clause 16, Article 6 of Decree 168/2024/ND-CP regarding license points deduction when committing the usage of a phone violation:

16. Besides being subject to penalties, drivers committing a violation also have points deducted from their driving license as follows:

b) Committing the violation specified in point h, clause 5; clause 6; point b, clause 7; point b, point c, point d, clause 9 of this Article results in a deduction of 04 points from the driving license;

...

d) Committing the violation specified in point a, clause 9, clause 10, point đ, clause 11 of this Article results in a deduction of 10 points from the driving license.

Thus, besides a monetary fine, offenders using a phone while driving a car will have 04 points deducted from their driving license; if the violation causes a traffic accident, 10 points will be deducted from the driving license.
