1. What is the imprisonment sentence for organizing football betting in Vietnam?

According to Article 322 of the Vietnamese Criminal Code 2015 (amended in 2017), the act of organizing illegal football betting will be prosecuted under the following penalties:

Basic Penalty Framework:

- A fine from VND 50,000,000 to VND 300,000,000 or imprisonment from 1 year to 5 years for organizing gambling under one of the following circumstances:

+ Organizing for 10 or more people to gamble at the same time with the total money and assets used for gambling worth VND 5,000,000 or more, or organizing 2 or more gambling tables at the same time with the total money and assets used for gambling worth VND 5,000,000 or more;

+ Using a location owned or managed by oneself to allow 10 or more people to gamble at the same time with the total money and assets used for gambling worth VND 5,000,000 or more, or allowing 2 or more gambling tables at the same time with the total money and assets used for gambling worth VND 5,000,000 or more;

+ The total money and assets used for gambling in one instance worth VND 20,000,000 or more;

+ Organizing a place for pawning assets for gamblers, installing equipment for gambling, assigning people to guard or serve gamblers, arranging escape routes when surrounded, or using means to assist in gambling;

+ Having been administratively sanctioned for one of the acts specified in Article 322 of the Vietnamese Criminal Code 2015 (amended in 2017) or the actions specified in Article 321 of the Vietnamese Criminal Code 2015 (amended in 2017) or have been convicted of the crime of organizing gambling or gambling, not yet expunged but still violating.

Aggravating Penalty:

- For committing one of the following offenses, imprisonment from 5 years to 10 years:

+ Acting professionally;

+ Illegal profit of VND 50,000,000 or more;

+ Using the internet, computer networks, telecommunications networks, or electronic means to commit crime;

+ Dangerous recidivism.

Supplementary penalty framework: Offenders may be fined from VND 20,000,000 to VND 100,000,000 or have part or all of their property confiscated.

Thus, if one engages in organizing illegal football betting, they will be fined from VND 50 million to VND 300 million or imprisoned from 1 year to 5 years.

More severely, the offender may be imprisoned for up to 10 years if the criminal act falls under one of the following categories:

- Acting professionally;

- Illegal profit of VND 50,000,000 or more;

- Using the internet, computer networks, telecommunications networks, or electronic means to commit the crime;

- Dangerous recidivism.

In addition, the violator may be fined from VND 20 million to VND 100 million or have part/all of their property confiscated.
