The Minister of Finance of Vietnam issued Official Dispatch 1767/BTC-TCCB on February 14, 2025, regarding guidance for implementing the early retirement policy, and voluntary resignation as per Decree 178/2024/ND-CP.

The template for applying for early retirement under the policy is stipulated in Appendix 05 issued together with Official Dispatch 1767/BTC-TCCB in 2025 as follows:

What are the conditions for benefiting from the early retirement policy in Vietnam under Decree 178?

The conditions for officials and public employees to benefit from the early retirement policy and voluntary resignation are stated in Section 2 Part II of Official Dispatch 1767/BTC-TCCB in 2025 as follows:

Officials, public employees, and workers who voluntarily apply for early retirement or voluntary resignation must meet one of the following conditions:

(1) Early retirement due to remaining service time calculating retirement age points from up to 10 years or less to the retirement age stipulated in Appendix I issued with Decree 135/2020/ND-CP or up to 05 years or less to the retirement age stipulated in Appendix II issued with Decree 135/2020/ND-CP and having sufficient time of compulsory social insurance payment to receive a pension according to law on Social Insurance.

(2) Voluntary resignation when meeting one of the following conditions:

- Officials, public employees holding leadership and management positions in units exceeding the number of leaders and managers as per the Communist Party and State regulations or officials and public employees holding leadership and management positions in units after reorganization holding lower leadership, management positions, or quitting leadership, management positions after reorganization.

- Officials, public employees, and workers have been classified as completing tasks or lower in 02 of the last 03 years (except for the case where there are 02 consecutive years classified as not completing tasks).

- Officials, public employees, and workers in the year before immediately or in the year considered for the resignation policy having a total number of sick leave days certified by the Social Insurance agency providing sick leave benefits according to the current regulations being equal to or higher than the maximum number of sick leave days as per Law on Social Insurance or suffering from long-term illnesses listed in the disease list needing long-term treatment as per Law on Social Insurance.

- Cases where legal changes result in failing to meet the training qualifications, job position requirements, official rank standards, professional title standards of public employees, leadership, management standards, but individuals voluntarily resign when assigned to another job position by the agency.

- Other specific conditions to the unit (if any). The heads of the vertically organized units, the State Securities Commission, public service providers under the Ministry of Finance provide specific guidance on unique conditions within the system units as a basis for determining individuals eligible for policies.

In cases where all aforementioned instances have been reviewed but are still insufficient to reduce the staffing of officials and public employees as required by the competent authority, if other individuals have suitable wishes, reasons, and meet the requirements under the Communist Party and State regulations, then the agency, organization, and unit directly managing and using officials and public employees report to the competent authority for approval for early retirement or voluntary resignation according to grading for consideration and decision.

Resolution timeframe for early retirement policy for officials and public employees in Vietnam

Also specified in Section 5 Part III of Official Dispatch 1767/BTC-TCCB in 2025, the resolution for early retirement and voluntary resignation policies for officials and public employees will be conducted monthly as follows:

- Before the 1st of each month, units send the list, dossiers of those proposing early retirement or voluntary resignation for the following month to the units responsible for appraisal (units advising on personnel organization, units advising on financial matters).

- Within 10 days, the unit advising on personnel organization must complete appraisal on the subjects with complete dossiers and send a document to the unit advising on financial matters to proceed with financial appraisal.

- Within 5 days from receiving the appraisal document from the unit advising on personnel organization, the financial advising units of the organization must complete the financial appraisal and send the appraisal document back to the personnel advising unit for consolidation.

- Within 2 days from receiving the financial appraisal document, the personnel advising unit consolidates and submits to the competent authority for approval.
