According to Clause 7, Article 3 of the Ordinance on Prevention and Combat of Prostitution 2003, the regulation is as follows:

Article 3. Explanation of Terminology

7. Procuring prostitution is the act of enticing or leading by a middle person for the parties to engage in prostitution activities.

Procuring prostitution is the act of enticing or leading by an intermediary for the buying and selling of sex, with the purpose of gaining profit from this activity.

The offender can be an intermediary between the customer and the prostitute, aiding in arranging, advertising, or connecting between the parties to conduct prostitution activities.Procuring prostitution may include organizing meetings, providing venues, or even supporting services related to prostitution.

What are penalties for procuring prostitution in Vietnam?

The penalties for the crime of procuring prostitution in Vietnam is stipulated in Article 328 of the Criminal Code 2015:

(1) Whoever acts as an intermediary to entice or lead another person to engage in the buying or selling of sex shall be subject to imprisonment for a period ranging from 06 months to 03 years.

(2) If the offense is committed in one of the following cases, the offender shall be subject to imprisonment for a period ranging from 03 years to 07 years:

- Against persons from 16 to under 18 years of age;

- Organized offense;

- Professional execution;

- Committing the offense 02 times or more;

- Against 02 or more persons;

- Earning illicit profits from 100,000,000 Vietnamese Dong to under 500,000,000 Vietnamese Dong;

- Dangerous recidivism.

(3) If the offense is committed in one of the following cases, the offender shall be subject to imprisonment for a period ranging from 07 years to 15 years:

- Against persons from 13 to under 16 years of age;

- Earning illicit profits of 500,000,000 Vietnamese Dong or more.

(4) The offender may also be fined from 10,000,000 Vietnamese Dong to 50,000,000 Vietnamese Dong.
