On November 27, 2024, the National Assembly of Vietnam promulgated the Trade Union Law, which comes into effect from July 1, 2025.

What is the Vietnam Trade Union?

According to Article 1 of the Trade Union Law 2024, the Vietnam Trade Union is defined as follows:

"The Vietnam Trade Union is a broad socio-political organization of the working class and workers, established on a voluntary basis, as a member within the political system under the leadership of the Communist Party of Vietnam; it represents workers, officials, and public employees (hereinafter collectively referred to as workers), and in conjunction with state agencies, economic organizations, and social organizations, cares for and protects the legitimate and rightful rights and interests of workers; participates in state management, socio-economic management; supervises and provides social feedback; participates in inspection, supervision of activities of state agencies, organizations, units, enterprises concerning issues related to the rights and obligations of workers; and propagates and encourages workers to learn to enhance their qualifications and skills, comply with the law, and participate in emulation movements to build and protect the nation."

What documents are required for joining the Vietnam Trade Union?

As stipulated in Clause 1, Article 6 of the Trade Union Law 2024 regarding the joining of the Vietnam Trade Union by workers' organizations in enterprises:

Article 6. Joining the Vietnam Trade Union by workers' organizations in enterprises

1. A legally established and operating workers' organization in an enterprise that voluntarily agrees with the Charter of the Vietnam Trade Union has the right to join the Vietnam Trade Union; the joining process is stipulated as follows:

The documents required for joining the Vietnam Trade Union include:

a) A written request to join the Vietnam Trade Union;

b) A copy of documents demonstrating the legal status of the workers' organization in the enterprise;

c) A document showing the decision of the workers' organization in the enterprise to join the Vietnam Trade Union; the method of approving the decision to join the Vietnam Trade Union is carried out according to labor law;

d) A list with signatures of members voluntarily joining the Vietnam Trade Union;

dd) Documents, agreements pursuant to relevant laws concerning the resolution of rights and obligations of the workers' organization in the enterprise and its members related to the workers' organization in the enterprise;

Thus, from July 1, 2025, the documents for joining the Vietnam Trade Union will include:

- A written request to join the Vietnam Trade Union;

- A copy of documents demonstrating the legal status of the workers' organization in the enterprise;

- A document showing the decision of the workers' organization in the enterprise to join the Vietnam Trade Union, with the approval method carried out according to labor law;

- A list with signatures of members voluntarily joining the Vietnam Trade Union;

- Documents, agreements pursuant to relevant laws concerning the resolution of rights and obligations of the workers' organization in the enterprise and its members related to the workers' organization in the enterprise;

What are procedures for joining the Vietnam Trade Union?

According to Clause 2, Article 6 of the Trade Union Law 2024, the procedures for joining the Vietnam Trade Union are as follows:

- The workers' organization in the enterprise sends the documents specified in Clause 1, Article 6 of the Trade Union Law 2024 to the competent provincial trade union, central industry, or equivalent;

- Upon receipt of a complete set of documents as specified in Clause 1, Article 6 of the Trade Union Law 2024, the competent provincial trade union, central industry, or equivalent considers and recognizes the joining of the workers' organization in the enterprise to the Vietnam Trade Union; if not recognized, a written reply must be provided, stating the reasons;

Note: Upon recognition of joining the Vietnam Trade Union:

- The workers' organization in the enterprise automatically ceases activities as a workers' organization within the enterprise. The competent provincial trade union, central industry, or equivalent is responsible for notifying the relevant state management agency of the recognition result for withdrawal of the issued registration;

- Workers who are members of the workers' organization in the enterprise, and who voluntarily and meet the conditions to join the Vietnam Trade Union, according to the Vietnam Trade Union Charter, are recognized as union members;

Additionally, the Vietnam General Confederation of Labor guides the process of joining the Vietnam Trade Union by workers' organizations in enterprises as stipulated in Article 6 of the Trade Union Law 2024.
