What are the changes regarding administrative procedures after the revocation of household registration book in Vietnam?

It is known that the physical household registration book is valid until the end of December 31, 2022. However, in many administrative procedures, a household registration book is required for verification. So by the beginning of 2023, how will these procedures change in Vietnam? "Long Khanh-Dak Lak"

Lawnet would like to answer your questions as follows:

1. Time of revocation of household registration book in Vietnam

According to Vietnam's Law on Residence 2020, stipulating important milestones for the issuance and use of household registration books, people should note the following:

- From July 1, 2021: Revocation of household registration book in case of information change; Stop issuing new household registration books;  issued household registration books and temporary residence registers may continue to be used. In case where information in a household registration book or temporary residence register differs from information in the residence database, the latter shall be used.

- From January 1, 2023: All household registration books are no longer valid.

Thus, the issued household registration book will still be used and valid as documents confirming residence until the end of December 31, 2022. From January 1, 2023, all household registration books are no longer valid.

2. What are regulations on related administrative procedures once the revocation of household registration book take effect in Vietnam?

The revocation of a household registration book means that all information about citizens in the revoked household registration book has been fully updated on the National Population Database.

The purpose of requesting the previous household registration book is to confirm the personal information of the individual. Therefore, when carrying out related procedures requiring previous household registration books such as enrollment registration, vehicle registration, housing records, etc., citizens' information will be exploited on the Residential Database to confirm without having to present the household registration book.

According to Clause 3, Article 22 of the Law on Residences 2020, within 07 working days starting from the date of receipt of an adequate and valid application, the registration authority shall appraise and update information on the new permanent residence of the applicant to the residence database and notify the applicant of such update; and provide a written explanation for the applicant if the application rejected.

In addition, according to the provisions of Article 37 of the Law on Residence 2020, the national database system will update information related to the last name, first name, date of birth, permanent residence, temporary residence, and current residence.

Thus, after the revocation of household registration book, citizens only need to present their citizen identification card with a chip attached to the competent authority to look up residence and identity information.

On the other hand, in order to adjust information about the head of household and civil status related to the household registration book, citizens need to comply with the provisions of Article 26 of the Law on Residence 2020 as follows:

Application for revision of residence information includes:

- Declaration of change to residence information;

- Written proof of the change.

Procedures for adjusting information about residences are carried out as follows:

Household members submit an application to the residence registration office.

Within 03 working days starting from the date of receipt of an adequate and valid application, the registration authority shall revise civil status information in the residence database and notify the applicant of such revision; and provide a written explanation for the applicant if the application rejected.
