What are regulations on classification of traffic accidents in Vietnam?

According to the new regulations, what are regulations on classification of traffic accidents in Vietnam?

In Vietnam, traffic accidents have always been a pressing issue, garnering special attention from the State, the Government of Vietnam, and the people. The Minister of Public Security of Vietnam has issued Circular 26/2024/TT-BCA, which stipulates the classification of traffic accidents in Vietnam.

1. What are regulations on classification of traffic accidents in Vietnam?

According to Article 5 of Circular 26/2024/TT-BCA, depending on the severity of the harm to people and property, traffic accidents are classified as follows:

(1) Traffic accidents causing particularly serious consequences in one of the following cases:

- Causing the death of 03 or more people;

- Injury or harm to the health of 03 or more people with a combined injury percentage of 201% or more;

- Property damage of VND 1,500,000,000 or more.

(2) Traffic accidents causing very serious consequences in one of the following cases:

- Causing the death of 02 people;

- Injury or harm to the health of 02 or more people with a combined injury percentage between 122% and 200%;

- Property damage between VND 500,000,000 and less than VND 1,500,000,000.

(3) Traffic accidents causing serious consequences in one of the following cases:

- Causing the death of 01 person;

- Injury or harm to the health of 01 person with an injury percentage of 61% or more;

- Injury or harm to the health of 02 or more people with a combined injury percentage between 61% and 121%;

- Property damage between VND 100,000,000 and less than VND 500,000,000.

(4) Traffic accidents causing less serious consequences in one of the following cases:

- Injury or harm to the health of one person with an injury percentage between 11% and less than 61%;

- Injury or harm to the health of 02 or more people with a combined injury percentage between 11% and less than 61%;

- Property damage between VND 10,000,000 and less than VND 100,000,000.

(5) Traffic collisions are traffic accidents causing consequences below the thresholds stipulated in item (4).

Determining the injury percentages caused by traffic accidents is carried out according to Circular 22/2019/TT-BYT issued by the Minister of Health of Vietnam.

Determining the property damage caused by traffic accidents is based on the asset valuation conclusions or appraisal certificates or other documents proving property damage.

2. What are the principles for the statistics, compilation, and construction of the Traffic Accident Database in Vietnam?

Also according to Article 4 of Circular 26/2024/TT-BCA, the principles for the statistics, compilation, and construction of the Traffic Accident Database in Vietnam are as follows:

- Ensure objectivity, honesty, accuracy, completeness, promptness according to the progress of investigation, verification, resolution of traffic accidents, and other professional requirements.

- Uniformity in statistical indicators, statistical forms; provide analysis and comparison.

- No duplication or overlap between statistical information; fully report mandatory fields according to the traffic accident report form.

- A single or multiple sequential collisions between traffic participants at a specific location are called a traffic accident. A traffic accident involves one or more traffic participants.

- Statistics of deceased persons in traffic accidents include those who died and those who were injured and then died within 07 days from the date of the traffic accident; if a traffic accident injury leads to death after 07 days, it must be confirmed by an official forensic medical organization for supplemental statistics.

- Statistics of injured persons in traffic accidents include those who require treatment and have medical records from medical facilities.

- If previously reported traffic accident data contain errors or if additional accidents, deaths, or injuries occur outside of the report period, these must be reported with detailed explanations for the adjustments and additions. Provincial police compile and report to the Ministry of Public Security (through the Traffic Police Department).

- Do not infringe on national interests or the lawful rights and interests of agencies, organizations, and individuals.
