According to Vietnam's Law on Animal Husbandry 2018, the basic livestock production scale includes the following:
a) Livestock farm including large, medium and small scale livestock farms.This is a form of organizing livestock production activities in a separate area for livestock production and business;
b) Family farm: a form of organizing livestock production activities at households.
Thus, for each scale, there will be different regulations on waste treatment.
Article 59 of the Law on Animal Husbandry provides for the treatment of waste from livestock farms as follows:
- Organically-originated solid waste shall be treated as follows:
+ Owners of livestock farms shall take responsibility to treat organically-originated solid waste meeting national technical regulations before use of such waste as fertilizers for plants or aqua feeds;
+ Organically-originated solid waste not undergoing treatment must be moved out the livestock farm to treatment places by dedicated equipment and vehicles;
+ Livestock died from epidemics and other hazardous waste must be handled under law provisions on animal health and environmental protection.
- Livestock wastewater shall be treated as follows:
+ Owners of livestock farms shall take responsibility to collect and treat livestock wastewater meeting national technical regulations on livestock wastewater before discharging such wastewater into the waste receiving place under law provisions on environmental protection;
+ Livestock wastewater undergoing treatment meeting national technical regulations on livestock waste may be used for plants;
+ Livestock wastewater not undergoing treatment must be moved out the livestock farm to the waste treatment facility by dedicated equipment and vehicles.
-Treatment of livestock emissions: Owners of livestock farms shall treat exhaust gases from animal breeding meeting national technical regulations on livestock exhaust gases.
- Treatment of other waste must comply with law provisions on veterinary and environmental protection.
Every owner of family farm must:
- Take measures to treat livestock excrement, wastewater and exhaust gases for the purpose of protecting environmental hygiene and not affecting surrounding people;
- Handle domesticated animals died from epidemics and other hazardous waste under law provisions on animal health and environmental protection.
Violations against regulations on treatment of livestock waste will be handled according to the provisions of Decree 14/2021/ND-CP.
Arccording to Article 30 of Decree 14/2021/ND-CP, the following are the fine levels for violations regarding the treatment of farm animal waste:
"1. Offences against regulations on treatment of solid wastes of organic origin shall be subject to the following penalties if such treatment does not conform to national technical regulations:
a) Imposing the fine ranging from 1,000,000 dong to 3,000,000 dong if such offences arise from small-scale animal farming activities;
b) Imposing the fine ranging from 3,000,000 dong to 5,000,000 dong if such offences arise from medium-scale animal farming activities;
c) Imposing the fine ranging from 5,000,000 dong to 7,000,000 dong if such offences arise from large-scale animal farming activities.
2. Offences against regulations on treatment of wastewater from animal farming shall be subject to the following penalties if such treatment fails to conform to the national technical regulations on wastewater from animal farming used for crops:
a) Imposing the fine ranging from 3,000,000 dong to 5,000,000 dong if such offences arise from small-scale animal farming activities;
b) Imposing the fine ranging from 5,000,000 dong to 7,000,000 dong if such offences arise from medium-scale animal farming activities;
c) Imposing the fine ranging from 7,000,000 dong to 10.000.000 dong if such offences arise from large-scale animal farming activities.
3. Offences against regulations on treatment of emissions from animal farming shall be subject to the following penalties if such treatment fails to meet the national technical regulations on emissions from animal farming:
a) Imposing the fine ranging from 3,000,000 dong to 5,000,000 dong if such offences arise from small-scale animal farming activities;
b) Imposing the fine ranging from 5,000,000 dong to 7,000,000 dong if such offences arise from medium-scale animal farming activities;
c) Imposing the fine ranging from 7,000,000 dong to 10,000,000 dong if such offences arise from large-scale animal farming activities."
Thus, violations against regulations on the treatment of livestock waste can be fined up to 10,000,000 VND. In addition, for violations of emission treatment, violators must also take measures to remedy environmental pollution and report the remedial results within the time limit set by the person with sanctioning competence determined in the decision on sanctioning administrative violations.
For household farming, the fines specified in Article 31 of this Decree are as follows:
Imposing the fine ranging from 500,000 dong to 1,000,000 dong for the act of failing to take measures to treat excrement, wastewater from animal farming activities for the purpose of protecting environmental hygiene and avoiding any impact on surrounding people.The remedies existing in the form of compulsory application of remedies for the environmental pollution and mandatory reporting on the results of implementation of remedies within the time limits prescribed in administrative sanction decisions issued by competent sanctioning persons shall be applicable to the offences stipulated in clause 1 of this Article.
