What are penalties for the crime of organizing gambling in Vietnam?​

According to Article 322 of the Vietnamese Criminal Code 2015 (amended in 2017), the crime of organizing gambling will be prosecuted under the following penalty:

Basic penalty:

- A fine ranging from VND 50,000,000 to VND 300,000,000 or a prison term of between 01 year and 05 years for those who organize gambling in one of the following cases:

+ Organizing for 10 or more people to gamble at the same time with a total amount of money and gambling materials valued at VND 5,000,000 or more, or organizing 02 or more gambling sessions at the same time with a total amount of money and gambling materials valued at VND 5,000,000 or more;

+ Using premises under one's ownership or management to allow 10 or more people to gamble at the same time with a total amount of money and gambling materials valued at VND 5,000,000 or more, or allowing 02 or more gambling sessions at the same time with a total amount of money and gambling materials valued at VND 5,000,000 or more;

+ The total amount of money and gambling materials used in a single session is valued at VND 20,000,000 or more;

+ Organizing places for pawning assets for gamblers; installing equipment to serve gambling or assigning people to guard, serve during gambling; arranging escape routes when surrounded, using means to aid gambling;

+ Previously fined for administrative violations as prescribed in Article 322 of the Vietnamese Criminal Code 2015 (amended in 2017) or as prescribed in Article 321 of the Vietnamese Criminal Code 2015 (amended in 2017) or previously convicted of the crime of organizing gambling or gambling, which have not been expunged but continue to reoffend.

Content excerpt: During gambling, Nguyen Quang H assigned Do Quang H (an employee of Quang H's family's Karaoke bar) to guard and watch for gamblers. Nguyen Quang H and Do Quang H1 agreed that Do Quang H1, in addition to being a karaoke employee for Nguyen Quang H’s family with a salary, would also guard for the gambling activities at H’s house. Around 02:00 on the same day, Duong Thi H and Luong Thi S came to H1's house intending to gamble. Nguyen Quang H instructed Do Quang H1 to open the door for Hai and Sen to enter the house to join the gambling. Around 02:50 on the same day, when the gamblers were caught red-handed by the Luc Yen District Police task force, material evidence was seized.

Content excerpt: At 11:40 on December 29, 2021, the Commune Police caught an illegal cockfighting gambling site for money on the land of Mr. Nguyen Van Lq8. 08 individuals were detained, along with evidence including: 03 (three) roosters, 03 (three) pairs of steel spurs, 40 (forty) rolls of tape, 01 (one) 05 kg scale; 02 (two) decks of 52 cards; 21 (twenty-one) pairs of slippers of various types.

At the Police Department, the suspects confessed as follows: On December 29, 2021, Tran Van Lq4 went to Huynh Van Bc's restaurant and met someone named Lq9. At this time, Bc arranged a cockfight for Lq4 and Lq9 to bet money, and they agreed. Bc led everyone to Mr. Nguyen Van Lq8's land to organize the cockfight (empty land without buildings, and Mr. Lq8 was unaware). Bc provided tape, scales, and acted as referee, arranging matches and judging winners and losers. After each fight, the winning side paid Bc a referee fee of VND 200,000.
