What are penalties for avoiding military service in 2024 in Vietnam?

Military service is a glorious obligation of citizens serving in the People's Army. Performing military service includes active duty service and service in the reserve component of the People's Army.

According to the provisions of Article 332 of the Criminal Code 2015 regarding the crime of evading military service as follows:

Article 332. Crime of Evading Military Service

1. Anyone who does not comply with the law regarding military service registration, does not comply with the call to active duty, the call for training concentration, and has been administratively sanctioned for this behavior or has been convicted of this crime, has not had their criminal record expunged and continues to violate, shall be subject to non-custodial rehabilitation for up to 02 years or imprisonment from 03 months to 02 years.

2. Committing the crime under one of the following circumstances shall be subject to imprisonment from 01 year to 05 years:

a) Intentionally inflicts injury or causes harm to one's own health;

b) Commits the crime during wartime;

c) Incites others to commit the crime.

Thus, individuals who evade military service can be subject to imprisonment. Specifically, those who do not comply with the call to active military service or training concentration and have been administratively sanctioned and continue to violate, can be subject to non-custodial rehabilitation for up to 2 years or imprisonment from 3 months to 2 years.

In cases of serious offenses such as self-inflicted injury, violation during wartime, or inciting others to commit the crime, the imprisonment term ranges from 1 year to 5 years.
