What are levels of the Vietnam Trade Union?

According to Clause 1, Article 8 of the Vietnam Trade Union Law 2024, the Vietnam Trade Union is a unified organization comprising the following four levels:

a) The central level is the Vietnam General Confederation of Labor;

b) The provincial-level, central sector, and equivalent trade unions include labor federations of provinces and central-affiliated cities (herein referred to as provincial labor federations); central sector trade unions; trade unions of economic groups, trade unions of corporations under the Vietnam General Confederation of Labor;

c) The immediate superior grassroots trade unions include district labor federations, district-level towns, cities under the province, cities under a centrally governed city (herein referred to as district labor federations); local sector trade unions; trade unions of economic groups, and corporations not covered by point b of this clause; trade unions in industrial zones, export processing zones, economic zones, high-tech zones; other immediate superior grassroots trade unions as stipulated by the Vietnam Trade Union Charter;

d) Basic-level trade unions include grassroots trade unions and grassroots unions.

Thus, the Vietnam Trade Union is a unified organization comprising the following four specific levels:

- The central level is the Vietnam General Confederation of Labor

- Provincial labor federations

- Basic-level trade unions, including grassroots trade unions and grassroots unions

Additionally, the Vietnam General Confederation of Labor decides on the establishment and determines the level of trade union for administrative-economic special units based on the National Assembly's resolution on the establishment of special administrative-economic units.

Furthermore, the trade union organizational model is built towards openness, flexibility, and suitability to the legitimate needs and aspirations of union members and workers, the practical requirements, and legal regulations. The Vietnam General Confederation of Labor is responsible for guiding the implementation of the contents stipulated in Clause 3, Article 8 of the Vietnam Trade Union Law 2024.

1. The trade union is established on a voluntary basis; organized and operates under the principle of democratic centralism; collaborates and cooperates with employers while ensuring the independence of the trade union organization.

2. The trade union is organized and operates according to the Vietnam Trade Union Charter, in accordance with the guidelines and policies of the Communist Party and the laws of the State.

Thus, the organizational and operational principles of the Vietnam Trade Union are as follows:

- The trade union is established on a voluntary basis; organized and operates under the principle of democratic centralism; collaborates and cooperates with employers while ensuring the independence of the trade union organization.

- The trade union is organized and operates according to the Vietnam Trade Union Charter, in alignment with the guidelines and policies of the Communist Party and the laws of the State.

What are the sources of trade union finances in Vietnam?

According to Clause 1, Article 29 of the Vietnam Trade Union Law 2024, the sources of trade union finance include:

- Trade union dues paid by trade union members as prescribed by the Vietnam Trade Union Charter;

- Trade union funding paid by agencies, organizations, units, enterprises, cooperatives, and unions of cooperatives at the rate of 2% of the wage fund as a basis for paying compulsory social insurance for employees;

- State budget allocations;

- Other income from cultural, sports, economic activities of the Trade Union; from projects assigned by the State; from lawful aid and sponsorship from domestic and foreign organizations and individuals as prescribed by law.

Simultaneously, the Government of Vietnam regulates the methods, deadlines, and sources for paying trade union funding; the cases of non-payment or late payment of trade union funding; and the contents of state budget support as stipulated in point c, clause 1, Article 29 of the Vietnam Trade Union Law 2024.
