1. Which cases are not granted credit in Vietnam?

According to the provisions of Article 134 of the Law on Credit Institutions 2024, the following cases are not eligible for credit grant:

(1) Credit institutions and branches of foreign banks are not allowed to grant credit to the following entities and individuals:

- Members of the Board of Directors, members of the Members' Council, members of the Supervisory Board, the General Director (Director), Deputy General Directors (Deputy Directors) and equivalent positions according to the regulations in the Charter of that credit institution; the General Director (Director), Deputy General Directors (Deputy Directors) of that foreign bank branch; legal entity shareholders whose capital contribution representative is a member of the Board of Directors, a member of the Supervisory Board of the credit institution as a joint-stock company; legal entity members contributing capital, owners of a credit institution as a limited liability company;

- Spouses, parents, children, siblings of members of the Board of Directors, members of the Members' Council, members of the Supervisory Board, the General Director (Director), Deputy General Directors (Deputy Directors) and equivalent positions according to the regulations in the Charter of that credit institution; the General Director (Director), Deputy General Directors (Deputy Directors) of that foreign bank branch.

(2) The regulation in (1) does not apply to people's credit funds and in the case of credit granting in the form of issuing credit cards to individuals.

(3) Credit institutions and branches of foreign banks are not allowed to grant credit to customers based on the guarantee of the subjects specified in (1). Credit institutions and branches of foreign banks are not allowed to ensure any form for credit institutions, branches of other foreign banks, to grant credit to subjects specified in (1).

(4) Credit institutions are not allowed to grant credit to enterprises operating in the securities business sector that are subsidiaries or affiliates of that credit institution.

(5) Credit institutions are not allowed to grant credit based on receiving security in the form of shares of the credit institution or subsidiaries, affiliates of the credit institution.

(6) Credit institutions and branches of foreign banks are not allowed to grant credit to contribute capital or purchase shares of the credit institution.

(7) Credit granting as specified in (1), (3), (4), (5), and (6) includes activities of purchasing, holding, and investing in corporate bonds.
