What are 08 prohibited acts in the protection of individuals particiapting in anti-corruption and anti-negative behaviors in Vietnam according to the Decision 231?

On January 17, 2025, the Politburo of Vietnam issued Regulation 231-QD/TW on protecting anti-corruption, wasteful, and negative activists.

The acts prohibited in protecting anti-corruption, wasteful, and negative activists are stipulated in Regulation 231-QD/TW 2025 as follows:

(1) Using violence, exerting pressure, slandering, isolating, insulting, or infringing on the legal rights and interests of anti-corruption, wasteful, and negative activists and their relatives.

(2) Illegally infringing on houses, residences, seizing or destroying property, insulting dignity, honor, or committing acts affecting the health, personal safety of anti-corruption, wasteful, and negative activists and their relatives.

(3) Retaliating or hiring, coercing, inciting others to mentally threaten, retaliate against anti-corruption, wasteful, and negative activists and their relatives.

(4) Implementing non-conformable, discriminatory, imposing criteria, conditions, comments, assessments detrimental in personnel work, rewards, discipline towards anti-corruption, wasteful, and negative activists and their relatives; transferring, mobilizing, seconding anti-corruption, wasteful, and negative activists while cases are being resolved.

(5) Causing difficulties, obstructing when implementing policies, policies of the Communist Party, State, resolving administrative procedures, public services as per law, production, business, profession, employment, labor, studying activities, or performing duties of anti-corruption, wasteful, and negative activists and their relatives.

(6) Preventing, destroying information, documents, evidence on anti-corruption, wasteful, and negative struggles; concealing, not reporting, delaying or improperly handling, verifying protection requests, needs; disclosing information that needs to be kept confidential during protection; not promptly directing, resolving difficulties, obstacles of organizations, individuals in performing protection tasks; not changing members performing protection duties when there are bases to determine those members lack responsibility, objectivity in duty execution.

(7) Exploiting anti-corruption, wasteful, and negative struggles to slander agencies, organizations, other individuals.

(8) Other prohibited acts according to the regulations of the Communist Party, State law.

What are the contents of protecting individuals combatting corruption, waste, and negativity in Vietnam?

According to Article 4 of Regulation 231-QD/TW 2025 on the content of protecting anti-corruption, wasteful, and negative activists:

Article 4. Protection Content

1. Anti-corruption, wasteful, and negative activists and their relatives are protected for confidentiality of identity and other personal information; life, health, property, honor, dignity, work position, employment; and other legal rights and interests as per legal regulations.

2. The measures for protection, authority, procedure, handling time follow current legal regulations.

At the same time, the principles for implementing the protection of anti-corruption, wasteful, and negative activists are as follows:

- The Party Committee, party organization, and leaders must promptly direct and resolve, within authority, the information on anti-corruption, wasteful, and negative struggles; ensure confidentiality of information, documents according to legal regulations, guarantee comprehensive leadership and direction of the Communist Party in protecting anti-corruption, wasteful, and negative activists.

- Anti-corruption, wasteful, and negative activists and their relatives are promptly afforded protection measures to ensure safety; their legal rights and interests are protected.

- Proactively prevent, detect, promptly stop and strictly handle organizations, individuals who threaten, retaliate, repress anti-corruption, wasteful, and negative activists and those taking advantage of anti-corruption, wasteful, and negative struggles to falsely accuse, distort the truth, cause internal discord.

Thus, anti-corruption, wasteful, and negative activists and their relatives are protected in terms of confidentiality of identity, life, health, property, honor, work position, and legal rights and interests. Protection measures are implemented in accordance with legal regulations.
