Waiting for the promise to return the investors' House ownership certificate

After the joy of buying shelter, people in many projects in Ho Chi Minh City are suffering because the story of waiting for is still not given a House ownership certificate.

The Difficulties

Reflecting on the Labor newspaper, Ms. Le Thi Ngoc Quynh, a permanent resident at Apartment CC1-Jovita, Hanh Phuc Residential Area of Construction Corporation No. 1, as an investor in Binh Chanh District, Ho Chi Minh City, said that she bought the apartment at the project in September 2016 and received the apartment handover in January 2017. And so far she has not received the Certificate of Home Ownership. On November 15, 2018, the Owner sent an Official Dispatch No. 2009/NCPT&T promising to issue a House ownership certificate for people in 2019. But when the deadline came, they didn't fulfill their promise. After learning the information that residents will initiate mass lawsuits, on May 11, 2022, the investor invited the Board of Directors of Blocks A, B, C, D to meet and issued Official Dispatch No. 545/TCT-DT with the content of promising to issue a House ownership certificate for residents in 2023. However, the people had almost no faith in the investor's promise. It is impossible to wait, instead, people living here have made strong moves to claim rights such as requesting dialogue with the owner, collecting signatures of residents and sending complaints to the authorities.

In the Official Dispatch replies to the reason for the slow issuance of the book, the investor is Construction Corporation No. 1, which said that the reason is because the project has 4 investment stages and currently still has many difficulties in the clearance and compensation of households under the project scope. This leads to difficulties in the implementation of financial obligations, so the legal documents for applying for a House ownership certificate are still blocked.

In addition, the story of slowing down the commission book is also related to the "bottleneck" related to the story of financial obligations. According to the data in the summation of recommendations of Ho Chi Minh City Real Estate Association (HoREA), Ho Chi Minh City has more than 20,000 apartments with a House ownership certificate because of additional financial obligations or land use fees. Problems related to the calculation of additional financial obligations alone account for about a quarter of the total number of projects currently in arrears (38 real estate projects of 29 enterprises). Most projects have financial obligations arising from changes such as adjustment of planning, project boundaries compared to the approved planning, so additional financial obligations will have to be charged.

Waiting for the answer of the authorities

It is worth mentioning, the extra charge of the authorities to answer the business too long, even the people who have entered and still have to wait for the book. Application for Project 8X Thai An (Ward 14, Go Vap District) invested by Dat Lanh Real Estate Company Limited. The project has an area of more than 3,600 square meters, has been accepted, handed over and put into use since 2016. But since then, the People's Committee of Ho Chi Minh City has not approved the land price, because it is still considering adjusting the decision to change the purpose to determine whether or not financial obligations arise, leading to the procedure of issuing certificates for residents stalled.

In addition to the projects that are awaiting additional financial obligations, Ho Chi Minh City also has a series of projects that have been handed over to residents for many years, but have been "soaked" in the House ownership certificate because the state agency has not calculated the land use fee. Typically, the Riverside Complex (Khai Vy Residential and Commercial Complex, Phu Thuan Ward, District 7) of Khai Thinh Real Estate Joint Stock Company, with an area of 77,000 square meters is being completed. The project has decided to change the land use purpose since 2019, but so far has not been processed to submit the land price approval dossier, although the Company has repeatedly made a written proposal to the Department of Natural Resources and Environment for early settlement of land use appraisal procedures for the Company to fulfill its financial obligations.
