2. When is the evaluation and ranking of the quality of civil servants of the Ministry of Finance carried out in Vietnam?

According to Article 3 of Decision 2188/QD-BTC 2021, the time for annual assessment and ranking of civil servant quality is prescribed as follows:

- The time to evaluate and classify the quality of civil servants is conducted before December 15 every year, before evaluating and ranking the quality of party members and summarizing the annual emulation and commendation work of agencies, organizations, and units.

For higher education institutions under the Ministry, the Principal (Director) decides on the time to evaluate and classify the annual quality of public employees of the unit according to the school year or calendar year; In the case of evaluating and ranking the quality of public employees according to the school year, the time to evaluate and classify the quality of public employees is before September 15 every year.

- Based on the actual situation of the agency, organization, and unit, the collective leadership of the agency, organization, and unit agrees with the Party Committee at the same level on combining the organization of meetings to evaluate and classify the quality of civil servants and public employees and classify party members in their organizations and units, ensuring seriousness and efficiency and avoiding formality and waste.

- At the time of quality assessment and grading, in case of absence with a legitimate reason or sick leave or maternity leave according to the provisions of law, civil servants and public employees are responsible for making reports on the quality assessment and classification sheet according to assigned responsibilities and tasks and sending them to the agencies, organizations, and units they are working at to carry out quality assessment and grading according to the provisions of law and Decision 2188/QD-BTC 2021.

Thus, the time to evaluate and classify the quality of civil servants in the Ministry of Finance is carried out every year before December 15, before evaluating and ranking party members and summarizing emulation and reward work.

For higher education institutions, this time is before September 15 every year. In case of absence with a legitimate reason, civil servants still have to make a report to be evaluated and ranked.

3. What are the procedures for evaluating and grading the quality of civil servants in Vietnam?

According to the provisions of Article 8 of Decision 2188/QD-BTC 2021, the order and procedures for evaluating and classifying the quality of civil servants are as follows:

For civil servants, it is the head and deputy head of the administrative unit

Step 1: Civil servants self-assess and classify quality.

- Civil servants make reports on the quality assessment and grading form according to assigned responsibilities and tasks according to Form No. 01 in the Appendix attached to Decision 2188/QD-BTC in 2021.

Step 2: Organize a meeting at the unit where the civil servant works to comment and evaluate the civil servant.

- Participants in the meeting include all civil servants of the unit. In cases where a unit has constituent units, the composition includes the collective leadership of the unit; representatives of party committees, trade unions, youth unions at the same level, and heads of constituent units. The meeting is chaired by the Head of the unit.

For the position of General Department Leader and equivalent in the Ministry, the meeting is chaired by the Ministry Leader or as assigned or authorized by the Ministry Leader; meeting participants include:

+ General Department Leadership Team; representatives of the Party Committee, trade unions, and Youth Union of the General Department; Heads of Departments, Bureaus, and equivalents belonging to and directly under the General Department. Particularly, the participating members of the State Securities Commission also include the Chairman of the Board of Directors and the General Director of the Vietnam Stock Exchange and the Vietnam Securities Depository Center.

In case heads of units under the General Department cannot attend the meeting (in person or online), they can contribute comments and evaluations in writing.

+ Representative of the Department of Personnel Organization - Ministry of Finance.

- Civil servants present self-assessment reports on work results at meetings; members attending the meeting contribute their opinions; opinions must be fully recorded in the minutes and approved at the meeting.

Step 3: The unit collects written comments and assessments from the party committee of the unit where the civil servant works.

Step 4: Consider and decide to evaluate and classify the quality of civil servants.

- For the head, the unit sends the evaluation form, minutes, evaluation results, comments in steps 1, 2, and 3 above, related documents (if any), and a list of proposed rating levels according to Form No. 03 in the Appendix attached to Decision 2188/QD-BTC 2021 to the Department of Personnel and Organization to synthesize and propose assessment content and quality rating levels and submit them to the Minister for decision on assessment and classification of civil servant quality.

- For the head's deputy, the head of the unit, based on the evaluation form, minutes, evaluation results, comments in steps 1, 2, and 3 above, and related documents (if any), to decide the content of the assessment and the level of quality rating of civil servants.

Step 5: Announce the results of the assessment and ranking of civil servant quality according to the provisions of Article 19 of Decision 2188/QD-BTC 2021.

For civil servants holding leadership and management positions at the Department level (and equivalent) under the Ministry, civil servants holding leadership and management positions at all levels under the General Department and civil servants not holding leadership or management positions under the management authority of the head

Step 1: Civil servants self-assess and classify quality

- Civil servants make reports on the quality assessment and grading form according to assigned responsibilities and tasks according to Form No. 01 in the Appendix attached to Decision 2188/QD-BTC in 2021.

Step 2: Organize a meeting at the unit where the civil servant works to comment on and evaluate the civil servant

- Participants in the meeting include all civil servants of the unit or all civil servants of the constituent unit where the civil servant works, if the unit has constituent units. The meeting is chaired by a representative of the Department's leadership.

- Civil servants present self-assessment reports on work results at meetings; members attending the meeting contribute their opinions; opinions must be fully recorded in the minutes and approved at the meeting.

Particularly for General Departments and equivalents under the Ministry, the implementation is as follows:

- For Department-level Leaders of the General Department and Local Department Leaders of the General Department, the General Department Leader, or as assigned or authorized by the General Department Leader to chair the meeting, the meeting participants are as follows:

+ For unorganized units (Departments): all civil servants belong to the Department.

+ For organizational units (Departments, Offices): collective leaders of Departments and Offices; Representatives of party committees, trade unions, and youth unions; Heads of departments and equivalent levels of Offices, Departments, and Branches of local Departments.

In case the Heads of Branches under the Department cannot attend the meeting (in person or online), they can provide comments and evaluations in writing.

+ Representative of the Department of Personnel and Organization under the General Department (if necessary).

- For Department-level Leaders and equivalents of Offices and Departments (including Branch Leaders and equivalents of local Departments), Office and Department Leaders or as assigned or authorized by the Office Leader, the Department chairs the meeting with the following participants:

+ All civil servants belonging to the Department, Branch and equivalent.

In case the Branch has constituent organizations (groups, teams, etc.), the members include Branch leaders, representatives of the party committee, trade unions, and youth unions of the branch; Team leader or equivalent of the Department.

+ Representative of the department in charge of personnel organization under the Department (if necessary).

- For leaders of groups and teams of branches, civil servants who do not hold leadership positions in groups and teams of branches, and civil servants who do not hold leadership positions in a Branch without a constituent organization, the Branch Leader or as assigned by the Branch Leader presides over the meeting with the following participants:

+ For groups and teams, it means all civil servants belonging to the group or team.

In case the Branch does not have an organizational structure, it is composed of all civil servants belonging to the Branch.

+ Representative of the department to synthesize and advise on staff organization at the Branch (if necessary).

- For civil servants who do not hold leadership positions under the Authority; Civil servants who do not hold leadership positions in Divisions of Offices or Departments (excluding Branches), participants in the meeting are as follows:

Chair:

+ For civil servants under the Department: Department leaders.

+ For civil servants in departments under Offices and Departments: Department Leaders.

Composition: all civil servants belonging to the Authority or Department where the civil servant works.

Step 3: Get written comments and assessments from the party committee at the same level as the unit where the civil servant works (for civil servants holding leadership and management positions).

Step 4: Consider and decide to evaluate and classify the quality of civil servants.

The head of the unit will base decisions on the evaluation form, opinions at the unit's review and evaluation meeting, and relevant documents (if any) to decide on the evaluation content and quality rating for civil servants. .

Step 5: Announce the results of the assessment and ranking of civil servant quality according to the provisions of Article 19 of Decision 2188/QD-BTC 2021.
